How is that the House Minority Leader can mix up the U.S. Constitution with the Declaration of Independence in front of a Tea Party crowd at the Capitol? Who knows..but he did it, pulling out his pocket copy of the Constitution he's pledged to uphold, today pledging to "stand here with our Founding Fathers, who wrote in the preamble: 'We hold these truths to be self-evident ..."

SANCHEZ: And do you believe it? As most fifth-graders would know, the document Boehner was quoting is not the Constitution. It's the Declaration of Independence. I'm assuming he knows the difference, but maybe -- I'm not sure now.
Those other House Republicans, the ones behind him, Roy Blunt, Virginia Foxx, Michele Bachmann, are they cringing in despair or just blissfully unaware? I don't know.

By the way, the language of the Preamble is far less eloquent and meaningful than what Boehn-Head mistook it for.

We do have to be careful about invoking that phrase. There is no enumerated federal power simply to do whatever the federal government feels is in the general welfare at the time. If the Constitution were interpreted that way, there would be no limit to the federal government at all. All it would have to do is invoke the general welfare clause.
The enumerated power is simply to "tax and spend" in the general welfare. Had Obama been a better Constitutional scholar himself, he could have distinguished the enumerated Constitutional power from "Socialized Medicine" by arguing that all he wants the government to do is set up a spending program that will help the economy and unemployment by ensuring that Americans have health care. Perfectly Constitutional. Unlike, say, the British NHS, which actually hires and fires doctors, and runs the health care of the UK.
The Constitution then sets forth the framework through which those goals are to be achieved, and it's tied to the Bill of Rights.
It's never been a blanket permission / 'the state is always right', IMHO, unless you're riding the Unitary Executive Express like King George XLIII.

There is nothing in the constitution which establishes our duty of maintaining the world's largest military budget either.

I know the Bill of Rights is part of the Constitution but neither The Bill of Rights nor the Constitution lists Life, Liberty, and the Pursuit of Happiness, that is from the Declaration of Independence which is not part of the Constitution. The Blogger had them confused same as Boehner.
The wingnuts continually quote from the Declaration so they can utilize the "Creator" reference and perpetuate their fiction that this is somehow an official Christian nation. Nowhere in the Constitution is there mention of God, the Creator, or any deity, or even "providence" - just We the People.
