From The Ed Show April 21, 2009. Pat Leahy responds to Dick Cheney's remarks and says if he feels so strongly about what he said, let him appear before his committee under oath and answer some questions.

John Amato:

Sen. Pat Leahy also wants a special prosecutor and a bipartisan commission to investigate the torture issue we've been presented with. He then took a very strong position against Jay Bybee and said that he should do the honorable thing and resign from the bench.

Leahy: If the Bush/Cheney administration told the truth about him, and he told the truth about what he did, he never would have been confirmed by the Senate. He never would have become a judge. I think the only decent and honorable thing for him to do now that these facts have come out is to resign. Resign for the good of the Judiciary. What he's done is a total blot on the and it reflects on him and the rest of the Judiciary and he should do the decent and honorable thing and step down.

The liberal blogosphere has been calling for him to be impeached, but if he was a true patriot he would step down and not bring a scandal to the bench. However, if a man can write a memo like that, then I highly doubt that is a realistic option.

I think Judge Bybee should read Digby's intense post called Torturers In Common, so he can take a hard look at what he has done.

I'm not convinced Congress has the stomach to do the right thing and move forward on this torture business. It will not be pleasant, as much as I might like seeing the crooks in the Bush administration exposed, and you know the right wingers will be shreeking the entire time. But do this we must. I believe most Americans can handle it, and will feel better in the long run. Not addressing it is like keeping some dirty family secret in the closet where it only continues to fester and contaminate for generations to come.

The more information comes out about the torture process, the more prosecution is going to seem like the best option. The Senate Armed Services Committee's report is pretty devastating -- when there was a huge amount of pushback from the military on using torture (the Navy, Air Force and Marines along with two law enforcement groups objected) Rumsfeld simply subverted the process and went to the OLC for their okay based on the flimsiest of rationales. Prosecution is absolutely called for.

...but I think this steady release of memos and reports will build the understanding of what was done and how awful the reality was compared to the Bushies' spin of it. But the MSM will be the last to tune into the reality of it.

There's already enough evidence for him to be disbarred - doesn't that force him out of a federal judgeship?

It's reassuring that you have people like Leahy in the Senate, yet I feel he may be a minority these days. Let's hope he can get others to listen.

this is a minor point compared to the "slam dunk" criminality of the bybee memo-it fails as a work product,as well.legal "cover" is not the same thing as legal analysis.except in limited areas where a corporation might be looking for loopholes in labor,disability,civil rights,consumer protection law etc,the client would require much more nuance than bybee,hu,addington etal provide-these guys seem to EXCLUDE all the material which refutes their predetermined conclusions and cherry picks the rest of the evidence.there is a gratuitous acknowledgement of the subjective nature of the law,the understandable paucity of cases,and ominously,the unpredictability of jury behavior.the rest of it is pumped up debate team claptrap with a little legal mumbo jumbo thrown in 'cause its supposed to be a legal memorandum.except in the narrow in house area i mentioned,jig rigged stuff like the bybee memo gets you in trouble in the private sector-trouble with clients for sure,and possibly with the bar association.when you provide the government with crap providing "legal" cover for torture they make you a damned federal judge.i don't really buy sen leahy's sub textual remark which implies that no-one in the senate knew about bybee's memos before he was confirmed-but his tone gives the impression that HE did not know.there is a remedy here,lets hope its used.
