Rachel Maddow last night featured a devastating report on Scott Roeder's overlooked connections to Operation Rescue and his multiple phone conversations with the organization's Cheryl Sullenger in the months leading up to the murder of Dr. George Tiller. She also explored the fact that Roeder had been violating federal laws protecting abortion clinics for some time, and yet authorities had failed to act.

McClatchy has more on the Operation Rescue connection in its report, Operation Rescue adviser helped Tiller suspect track doctor's court dates:

At the time of Roeder’s arrest Sunday afternoon along Interstate 35 in Johnson County, a television station captured the vehicle on video. There on the dashboard was a note that read “Cheryl” and “Op Rescue” with a phone number.

Cheryl Sullenger, senior policy adviser for Operation Rescue out of Wichita, said Tuesday that she has spoken to Roeder in the past, but she said he would initiate the contact. She said she hasn’t had any recent contact with him.

Sullenger served about two years in prison after pleading guilty to conspiring to bomb an abortion clinic in California in 1988. She has since renounced violent action.

She said Roeder’s interest was in court hearings involving Tiller.

“He would call and say, ‘When does court start? When’s the next hearing?’ ” Sullenger said. “I was polite enough to give him the information. I had no reason not to. Who knew? Who knew, you know what I mean?”

Morevoer, as Maddow reported in even more detail, the federal government had the power to stop the terrorism and threats of violence to abortion clinics under the FACE, or Freedom of Access to Clinic Entrances Act. Dr. Tiller's death could have been avoided had the government simply enforced the laws they had on the books. Amy Goodman made the same point in a guest blog on Air America's site, Amy Goodman: Dr. George Tiller Didn’t Have To Die. From the article:

George Tiller did not have to die. He was assassinated while in church in Wichita, Kan., on Sunday, targeted for legally performing abortions. His death might have been prevented simply through enforcement of existing laws. His alleged killer was seen vandalizing a Kansas City clinic, Aid for Women, both the week before and the day before the murder, putting glue into its door locks. The manager of that clinic, who calls himself "Jeff Pederson" to protect his identity, told me he called the FBI and local police both times, but the vandal, the alleged killer Scott Roeder, was not arrested. Pederson had Roeder's first name and his license-plate number. He had images of him on the security video. He recognized him from previous protests.

But Dr. Susan Robinson was adamant. She flies to Wichita every month to perform abortions in Tiller's clinic. She said, "It is generally regarded amongst those who do clinic security, if local authorities are not responsive, if they don't show up or they don't vigilantly enforce the law, that it encourages the anti-abortion people to push it further and further."

She said: "In Wichita, Dr. Tiller was constantly dealing with the same lack of enforcement. Wichita prohibits placing signs on city property. But they allow the anti-abortion protesters to set up dozens of crosses and leave them all day. Dr. Tiller went to the city attorney over the crosses, and complained that people block the clinic driveway. He told me that the city attorney said, ‘I would rather be sued by George Tiller than the anti-abortion folks.' "

The 1994 federal Freedom of Access to Clinic Entrances Act (FACE) makes it a crime to block or damage a reproductive health service facility.

Enforcing FACE saves lives. George Tiller will be buried on Saturday.

As Rachel reported the FACE Act was enforced under the Clinton administration but was all but ignored once Bush took office. After the murder of Dr. Tiller the question remains as to how the Obama administration will respond. From The Washington Independent:

As Rachel Maddow revealed in chilling detail in her MSNBC news show on Monday night, groups such as Rescue America, Prayer and Action News, Army of God and Operation Rescue Founder Randall Terry all appeared to be celebrating Tiller’s murder on Monday. And while extremists who promote violence against abortion providers could be prosecuted under state and federal law — and particularly under the federal FACE Act — the federal government in recent years has hardly prosecuted any such cases.

According to statistics provided by the Department of Justice, the Bush administration brought only about two criminal prosecutions per year in the entire country under the FACE Act , and never more than four in any single year. The Clinton administration, in contrast, prosecuted 17 defendants for violations of the FACE Act in 1997 alone, and an average of about 10 per year since the law was enacted in 1994. Those cases included one against a woman in 1996 who yelled through a bullhorn to a doctor, “Robert, remember Dr. Gunn. This could happen to you …”, referring to Dr. David Gunn, the first abortion doctor ever murdered, in 1993. In another case, a man who parked a Ryder truck outside a clinic shortly after the bombing of a federal building in Oklahoma City, where a Ryder truck had been used to carry explosives, was found to have threatened force. Stalking, arson and bomb threats are also illegal.

Whether the dropoff in prosecutions is because the FACE Act successfully deterred crimes after its enactment or because the Bush administration wasn’t interested in prosecuting them is not clear. “The amount of activity really did drop a lot after FACE was enacted and it was beginning to be enforced,” said Cathleen Mahoney, Executive Vice President of the National Abortion Federation who was an attorney in the Justice Department until 2006. “Certainly the political will wasn’t there.”

That’s disappointed Janet Crepps, deputy director of the legal program at the Center for Reproductive Rights. “I don’t think that the government has done enough,” she said, noting that while the Clinton administration had created a task force in the Department of Justice to coordinate responses to clinic threats and violence, during the Bush years, “we’ve heard that providers during that time would call DOJ for help and get no response.”

Justice Department spokesman Alejandro Miyar said Tuesday that the task force still exists, and in a statement released after the fatal shooting of Dr. Tiller, Attorney General Eric Holder said that “[f]ederal law enforcement is coordinating with local law enforcement officials in Kansas on the investigation of this crime.” It remains to be seen, however, whether the government will also investigate the anti-abortion activists who threaten abortion providers and may have worked with the actual murderer.

The FBI and local police fucked up, royally, on this one. Their indifference in putting an end to Roeder's terrorist activities contributed greatly to Dr. Tiller's assassination. They too, have blood on their hands.

I can only hope that the DOJ will look into the willful inaction on the part of law enforcement and some heads roll, big time. I also hope the DOJ investigates just how closely Operation Rescue is involved, and shuts that terrorist organization down for good.

I suspect that Operation Rescue was more than just a 'little' involved. I suspect they fully funded Mr. Roeder's escapades, were fully aware of each and every one of his steps, and knew EXACTLY what Roeder was going to do. I hope the Tiller family sues the shit out of Operation Rescue, rendering them not only morally bankrupt, but financially bankrupt as well.

And, I hope they sue law enforcement for their blatant inaction. Seems to me the Tiller family has a very good case for a wrongful death suit against both that terrorist organization and law enforcement.

Good luck with that - this crap has been going on for over 30 years - every time we have a pro-choice president they ramp up the violence. Until local, state and federal government take a woman's right to choose seriously this will continue to happen. Politicians are more afraid of the anti-choice movement that they are supportive of women, but then I can't recall any murders committed by pro-choice supporters.

Sometimes Rachel can get a little cutesy...but you have to give her her due. She, and her staff, do some fine investigative work, she's a very good interviewer and she does get great guests.

I sure wish Sullenger would have agreed to come on though. Or Maggie Gallagher. One constant about wingers though, they like echo chambers. None of them have the guts or the ability to defend their positions from criticism.

Her one favorited video? "Tiller the Killer", a video flagged as containing inappropriate material by YouTube. Sullenger has also removed any videos containing footage of herself. The Operation Rescue website about George Tiller still contains photographs and addresses of Dr Tiller's staff, however.

Compare the behavior of Operation Rescue with other organizations that were prosecuted under the RICO Act and one will be hard pressed to notice any difference. Me think some of these people realze that it mat easily come to that. How to otherwise explain Bill-O sudden distancing from the Tiller case?

It is past due time that federal law enforcement be instructed to put OR and its ilk under the "Domestic Terrorism" denomination. I don't see the Obama Administration doing that (for purely political reasons) but their behavior sure fit the description of the State Department.

I have to wonder why the Kansas prosecutors will not be turning this case over to a Federal Court since this appears to be a "hate" crime?

My understanding is that according to Kansas law, Roeder is NOT eligible for the death penalty and will be up for parole in 25 years.

I believe if this were to be tried under Federal Hate Crimes legislation he would either be sentenced to life without the possibility of parole or he'd get the death sentence.

How many groups like Operation Rescue have been investigated for terrorist activities? Has Army of God been classified as a terrorist organization by Homeland Security? The problem is government inaction. If guns were banned Roeder probably would have just stabbed him with a kitchen knife of just made a bomb, if not have acquired one though illegal channels. I doubt a gun ban would have saved Dr. Tiller.

Secondly, what percentage of legal gun owners go around committing violent crimes with them? I know a guy who owns what's basically an armory, but his attitude towards his guns is no different than a car collector's towards his collection.

But the DA in Sedgewick County did say that they won't seek the death penalty given the situation as it is known now. It wasn't ruled out entirely.

It's not easy to get a death penalty in Kansas, there are just very few circumstances that allow for it. But the idea of this guy getting parole in 25 years also isn't a given. If they go for, and get, the "hard 40," he ain't getting out. 40 years before any the first possibility of parole doesn't suck.

Looks like Cheyl Sullenger needs to focus on aborting some of those Happy Meals.

To make fun of her weight, though obviously I have. Two things though: Normal rules don't apply to people who are terrorists and if she spent less time plotting terrorist attacks and more time exercizing her body, (and not just Cheeto curls), she could be thinner. I have lost 58 pounds since the first part of March, strictly through diet and exercize so I know first hand and very personally how tough that can be. I also know how possible it is. 32 pounds to my ideal weight and my health is improving. Let's just keep that from Sullenger though, shall we? Maybe she'll die of a heart attack or something.

I've done 32 in one month and it damn near killed me (same way: diet and exercise) Please be careful.
I'm 'just sayin' and I certainly could stand to lose some weight right now so "Good on you!"

I work in a hospital and am doing it under the eyes of physicians. Trust me, I'm a scientist and I did my homework. I'm losing an average of 0.4 lbs per day right now, though the initial weight loss was faster. The safe limit for weight loss is usually agreed to be around 2.5 lbs per week and I'm losing about 2.8. Monitoring your health by a professional while losing is important.

My mom died of emphazema so I quit smoking and I ballooned. My dad died of colon cancer so I decided I needed to take that weight off. Two and a half years after I quit smoking, I started losing the weight because my health was suffering. There are people who can stay healthy and be overweight but I'm not one of them. I'd never weighed over 145 in my life until I quit smoking and I went up to 230! At the age of 49 though, I'm re-thinking my strategy of living 50 years instead of 100 and having twice as much fun. I set out to lose 90 lbs and I've lost 58 so far as of this morning.

That's great, Margaret! I hope to be able to lose a bunch myself this year. I am weaning myself off simple carbs to begin with.

Can totally identify with you, Margaret. I've lost 55lbs since last July and I feel so much better about myself and just feel healthier in general. I had a bad habit of eating when I was depressed or bored and my weight skyrocketed. My doctor basically told me - "lose weight or get diabetes" and I chose the former option.

While yes "a duty to all is a duty to none" in general would mean that the agencies are not liable, those repeated federal statute violations might changed things. If all Roeder did prior to the assassination was threaten Dr. Tiller, then no the agencies wouldn't be liable, but if they repeatedly failed to do anything after Roeder repeatedly violated those federal statutes then I think they can still get the agencies on at least negligence, if not gross negligence.

In something completely unrelated, our family was entitled to a certain government service, but it was inadequately provided...ultimately if we wanted that service, we were going to have to provide it for ourselves at our own expense in order to get the benefits of that service when it was needed. Which we did. It wasn't fair, but it was what was needed.

I completely agree that law enforcement failed here. Completely agree. And I wonder if Dr. Tiller's team was able to get any kind of security for themselves or the premises of the clinic ever.

The answer is, a) they're meant to be a witness, but nobody let them know when to show up, or b) they're making some sort of desperate plans.

You're kidding yourself if you think John Paul II was for intellectual freedom. Any theologian, and practically any faculty, at a Catholic university has to promise to teach ONLY current Catholic doctrine. It's almost a loyalty oath. And if current doctrine isn't quite what was taught a millennia ago, and you want to show how things have changed -- too bad.

Vatican II was also about returning some power back to the bishops -- and a tiny bit back to the laity. Paul IV and John Paul II shut it all down. Bishops have less power now than before John XXIII. JPII came from an authoritarian and autocratic regime in Poland and that's how he ruled the Church.
