Chris Matthews talks to Obama spokesperson Bill Burton and McCain spokesperson Nancy Pfotenhauer about the final days of the campaign. Pfotenhauer has a great tell: whenever she gets flustered and is desperately trying to spin the unspinnable, her smile gets wider and she laughs nervously. Matthews had her beaming like a high intensity flare over whose choice it was to spend the $150,000 on Palin's clothing, something the RNC has thrown back in the lap of the McCain campaign and how pathetic it is that Palin doesn't know what the role of the Vice President is.

MATTHEWS: We talked about the superficial, now let's talk the reality here. And I want to talk about this: the role of the Vice President. I want to give you a shot at it, Nancy, you're a pro. You're not somebody in from out of town. You know how politics works. What is the role of the Vice President under the Constitution? Simply put, you know it or you don't. Either a person understands the role of the Vice President or they don't. What—as you understand it from the Constitution – as a professional, is the role of a Vice President. It's very important you know this answer. We're filling the part in two weeks.

PFOTENHAUER: That's right. That's right. Well, I mean, obviously the role of the Vice President is to support the President, but to also to preside when necessary over the US Senate. And I think that this is also a tempest in a teapot…

MATTHEWS: No, that's not the role of the Vice President. I gave you a shot, Nancy, I want you to try again. What is the Constitutional role of the Vice President? In the Constitution? What's written in the Constitution? You're…look, you're all strict constructionists…

PFOTENHAUER: I'm not a Constitutional scholar but I do know …

PFOTENHAUER: I'm not a Constitutional scholar, but I have been reading the commentary on this and seems to me that people are parsing words and she was obviously trying to explain to a young child…

MATTHEWS: Let me…Okay, let's take a look at this…

PFOTENHAUER: …what the Vice President would do…

MATTHEWS: Nancy, I appreciate you coming on the show. It's a tough defense of this person, Sarah Palin.

PFOTENHAUER: Oh my…

MATTHEWS: Apparently, she doesn't understand. The role of the Vice President—let me state it very clearly right now—is to replace the President, if that is necessary. As Colin Powell said on Sunday, that's the job of the Vice President, to stand ready, under the Constitution in the tragic circumstances to replace the President. Now that's one role. The other role is to have only a tie breaking role, as presiding officer of the US Senate. That's it. The Constitution specifically prescribes that. In fact it says that's all the person has the right to do. Now here's Sarah Palin with her definition of this role, which sounds strange to me and I've been in this city a long time. I have never heard anybody say, and by the way, it's very similar to what she said in her debate with Joe Biden, which made me wonder then: where did she get her civics?

i haven't seen on this site yet, but on last night's Daily Show, Wasilla's Mayor was interviewed about what she does in her job... and if anyone saw that interview, they will have no question in their minds that Obama's experience as a "community organizer" 20 years ago was FAR MORE challenging and complex than that job... raising that experience as justification of palin's experience is just too bloody insulting to be considered anything more than pitifully laughable... the mayor of Wasilla has no more responsibility than an administrative assistant at practically any company... including an SME...

The operative phrase, "in charge of," is what eliminates any plausible denial of her egregious ignorance. And as well as Matthews handled it, it took him nine minutes to get there, while Burton completely bungled his opportunity.

After Palin said that I asked my 10 year old daughter what the Vice Presidents job was. She answered, "to be President if the President can't be and to vote if there is a tie" Ok, I'm pretty certain she hasnt read the constitution (although she does have a bookmark with the bill of rights on it) and if she can get this right with a 5th grade education why is it so hard for a potention VP to answer this correctly?

This is the third time Palin has stated her belief that the VP is in charge of the Senate. If the McCain people thought this impression should be corrected, it would have happened already. Her comments are not accidental and they are not plain stupidity. There has been a concerted effort on the part of some neocons to create a co-presidency within the veep's office and merge it with the legislative branch. She is merely giving advance notice of her intent. Cheney chipped away at it and attempted, unsuccessfully, to have the veep's office declared part of both the exec and legislative branches. This woman's sense of her own charm and her reckless ambition may lead her to believe she is capable of succeeding where Cheney failed. Our mistake would be to believe she's only a blithering idiot. She may be, but she is also an egomaniac. She is not demonstrating so much her lack of knowledge for the Constitution as she is her complete disregard for what it says if it conflicts with her ambitions.

He claims that becuase he is President of the Senate; he is part of the Legislative as well as the Executive Branch.

Executive Orders have always been used to govern conduct within the existing ROLES of government agencies.

Cheney has used his idea of the "Unitary Executive" to justify changing the roles of government agencies.

This was how he started the survelliance program and the torture program.

Cheney thinks he can write his own laws. Palin thinks the same thing.

Look at what Dick Cheeeeeney has done to the office. He, basically, IS the de-facto President, pulling the puppet strings of the dancing bobbling figurehead Chimp-n-Chief. I made my comment because, from my observation, Tweets doesn't always do that - he's been cowed by more than a few skilled right-wing hacks. But he's been getting better lately - check his destruction of Kevin James earlier this year, and his obliteration of Talkin' Michelle Malkin four years ago when she tried to pull the Swift Boat John Kerry dingleberry out of her kimut.

Seems like it is time to mail copies of the Constitution to Sarah Palin because the Republicans have decimated it to the point where even their own candidates don't know what it says. Maybe the DNC can find us a large quantity of the Constitution printed in a booklet that we could mail to Ms. Palin. Great visual and a way to keep this in the news cycle. The Constitution needs to be restored and this might be a good starting point.

Thank you Chris Matthews for hammering this issue. This should disqualify her from being a VP candidate if she doesn't even know what the constitution says about the office. You would think she would have learned by now after several times being questioned over it. Its kind of important I think (although apparantely not so important to the Republicans who do whatever they want even if it goes against the constitution).

As much as I enjoyed this - truly, truly enjoyed this - I can't help but think, and say, two things:

1) Give the woman a break. She knows she's going down on a sinking ship, and showed a bit of rather admirable grace under fire while bailing out the rising water as hard as she could with the itty bitty kiddy bucket the McCain campaign has left her with. And I only wish my teeth were as white as hers.

2) As much as I thought Matthews did a good job of hammering home the issue - what is the Constitutional description of the job of VP -and not allowing her to weasle the topic away to something else to avoid it, I couldn't help wishing he'd shown as much... excuse the obvious pub... teeth and aggressiveness when it really counted. Over the past eight goddamned years. Where were you and your journalistic integrity then, Mr. Matthews? Why weren't you grilling people about what the job of VP was when it was/is Cheney in the role? It's easy enough NOW to join the righteous side, when it likely that's the side that's winning. Now you just look like an opportunist.

Actually, Chris didn't get it quite right, either. The Constitution says the veep takes the president's place in the event of the latter's death or disability, yes. The VP only votes in the Senate in the event of a tie, yes.

But it calls the veep the "President of the Senate." Contrary to what CM appears to say, the veep is not the presiding officer only at the time of a tie vote but all the time. (That's why the person who hypothetically presides when the veep doesn't show - which is, of course, most of the time - is called the President pro tem.)

More to the point, when he says "it says that's all the person has the right to do," that's just wrong because what that means is that under the Constitution, the vice-president can do nothing other than preside over the Senate and wait for the president to die. Which is clearly untrue.

Even in the second grade I knew to study for a test. Don't you think Ms. Palin has had plenty of time to research the job she is asking the American people to give her? Maybe that second grader could lend her a book. If nothing else, can't somebody with the campaign just freakin' tell her?!?!

When Palin dropped that little bomb during the debate, I wondered why it wasn't being picked up in a bigger way by the media. I'm not able to stay totally on top of it all, so maybe I've missed it, but I'm still waiting to see a big public discussion about McCain's bomb, about wanting to put troops returning from active duty directly into the classrooms as teachers, without making them go through those pesky certification tests - what the heck was up with THAT, and why hasn't the Obama campaign jumped all over it?

Bill Sammon on Fox came out with some advice the other day saying 'parry', 'deflect', 'finesse', which was an insight. Others are divide, distort, distract. Goering had some words too. Anyway, it's all so negative and hopefully passe for the rest of the 21st c.

Listening to Nancy P-Fotenhauer here, honestly - there are some terrific soundbites of her grunting, sighing and exhaling rather enthusiastically to patch in for a cut-rate porno.

I'm going to watch this video all day.

I've had many disagreements with Chris Matthews hard-charging style in the past. Today, it served him very well. All too often the blovating talking heads like Nancy P here, succeed in changing the subject and redirecting the bullet. Not today. Kudos to Matthews who held her feet to the fire on this incredibly important point.
The fact is that Palin has repeated this same remark about "running the senate" and having a role in making policy "should the VP choose to do so" at least 4 times now. It is profoundly important that she not be able to get away with this assertion. We have seen what Cheney has done to manipulate policy behind the sceens, and I am 100% convinced that it was not Palin who came up with this cockimamie idea, but rather a Cheney/Addington/Yoo surrogate who is eager to continue to see the role of VP expand as Cheney has done. I'm half way through the new Cheney book ANGLER now, and it is a remarkable read. I highly reccomend it to anyone who wants to understand how the bush administration subverted the constitution.
Palin's retoric regarding the expansion of VP powers into policy making must be brought out into the open and flogged by every media outlet. What she is proposing is illegal, and profoundly wrong. The danger in letting this pass as some sort of minor gaff or a gap in her understanding of the constitution is underestimating the issue. She was told to pursue this talking point by somone up the chain of command in the RNC. This was no gaff. This was a trial ballon lofted to test market the idea, to see if the media and the electorate would push back. Matthews has done his part. Now it's time for the rest of the media to see this for what it is. This is the beginning of a power grab - plain and simple.

But a continuation....a passing of the torch, from one crooked, fascist administration to another...

In 1996, a faulty pipeline caused an explosion outside of Dallas in which two teenagers were killed. In a lawsuit related to the deaths, a trial court returned a judgement of $376.69 million against the company.

Sure, Olberman and Maddow have TV shows, but they don't jump all over the crazy neocons like this. Look at Maddows show from yesterday where Buchanan basically treated her like a child, and just got LOUDER as the went on.

I seldom agree with Chris Matthews as he played the Washington cocktail circuit insider for too long, but I will give him credit for dismantling Nancy Poopandholler piece by piece and handing both halves of her ass back to her! Sliced and diced like Ron Popeil's Veg-O-Matic!

The VP only comes up to bat on two occasions:
Breaking a tie vote in the Senate
Take over if the Prez croaks.
That's it, folks, nothing more, nothing to see here, keep moving. But Cheney through his Faux News megaphone has usurped powers never given to a VP in the Constitution.

Therefore, he has conspired against the Constitution and the People of the United States, and is therefore a traitor. The penalty for a traitor is death, so it's time for his physicians to stop restarting his pacemaker everytime God presses Cheney's off button.

Palin was wrong in saying that the VP is "in charge" of the Senate, but Pfotenhauer correctly stated taht part of the VP's role is "to preside when necessary over the US Senate" ("The Vice President of the United States shall be President of the Senate, but shall have no Vote, unless they be equally divided." President = one who presides).

(Of course, it's her own damned fault for allowing Matthews to pull her into defending Palin's incorrect claim by invoking Joe Biden and a bunch of other nonsense.)
