As Jed noted "What would a health care debate be without some good ol' fashioned race-baiting from the G.O.P.?" Stay classy Alexander. So let me get this straight...the Democrats want to steal from grandma to give to the "ghetto"...or did I miss something here?

Alexander: Every other word we hear coming from the other side is that this vote tonight is historic. And I agree it’s historic, but I think my view of why it’s historic is a little different than their view. And I wonder if my colleagues would not agree with me that this bill is historic in its arrogance—in its arrogance that we in Congress are wise enough to take this entire complex health care system that serves 300 million Americans, that is 16% of our economy, and write a, and think that we could write a 2000 page bill and be wise enough to change it all—all at once.

Or arrogant in the, in its dumping of 15 million low income Americans into a Medical Ghetto called Medicaid that none of us, or any of our families would ever want to be a part of for our health care.

Or arrogant in then sending to the states, who are going broke a big chunk of the bill for what we’ve just done. Or arrogant enough to tell Americans that the bill cost $849 billion and think we’re not smart enough to read the print and figure out that it’s actually $2.5 trillion when it actually is implemented. Or to tell us that paying for reimbursement for physicians is not an important part of a health care bill, and so they run over here in the dead of night—run up the deficit another quarter of a trillion dollars.

I can make a long list of reasons this bill is arrogant—arrogant enough to cut and tax grandma’s Medicare that’s going broke according to the trustees in 2015-2017 and then spend it on somebody else other than grandma.

I mean the bill is arrogant in its telling us that it’s going to reduce premiums for most Americans when in fact it increases premiums for most Americans. So people say “Where is the Republican health care bill?’ and my answer to that Mr. President is don’t expect Sen. McConnell to come rollin’ in here with a wheelbarrow with a 2000 page budget busting, debt ridden, arrogant piece of legislation because that’s not what we believe in.

What we need to do as a Congress is re-earn the trust of the American people by setting a clear goal of reducing health care costs, showing some humility and start moving step by step in that direction and I hope during this hour that we have a chance to talk about the specifics steps to reduce health care costs that we Republicans have offered day after day after day to no avail.

My friend, the minority leader, has had since Wednesday to read the bill. Obviously he hasn't done so.

We debate the right to live free of disease and death by giving health care for all. The road has started many times, never been completed. Merged bills have never been done before. We couldn't have got here without the help of many Senators.

As a matter of principle, that I respect, the senior Senator from Arkansas insisted we have time to read the bill. All Senators have now had ample time. That is why we are voting tonight.

I invite Republicans to join the right side of history. Around dining room tables, families are agonizing over what to sacrifice next to afford health care. Employers are wondering whether they can afford to provide health care. Americans need reform.

Debate is constant, but the only place where silence is evened considered is the Senate. Now, finally, we have the opportunity to bring this great deliberation to this body. That and nothing more is what this vote does.

A yes vote says this issue is important and the Senate should at least talk about it.

Some Republicans would like Americans to think voting to debate the bill is voting to pass the bill. Tonight's vote is only the beginning of debate. It's clear Republicans have no problem talking about health care on TV, at town hall meetings, on the radio, yet now that we have the legislation to debate, to amend, to build on, will they refuse to debate?

If we refuse to let the Senate do its job, what are we doing here? What do we fear? And who's voice to you speak for? In who's interest do you vote?

Certainly debating reform can't be more difficult than American deciding to pay their mortgage or medical bills. It can't be more upsetting than having an insurance company take away your coverage when you need it the most.

Kennedy once said let us not be afraid of debate or discussion, let us encourage it.

Sen. Al Franken explained why he supports the Senate health care bill.

Franken: From 2000 to 2007 American families saw their premiums almost double. During that same time, we saw more than six million more Americans became uninsured. And during that same time, insurance company profits rose 428 percent--428 percent. That’s all you need to know, that's all you need to know to understand why we have to pass this bill. 482 percent in 8 years. No wonder they’re fighting this bill. Of course they don’t want to be subject to antitrust laws. They’re making outrageous profits by gouging American families. Make no mistake, that’s what this is about.

Franken went on to explain which provisions of the bill would kick in immediately and reform the current system and that he hoped to try to improve the bill through the amendment process. You're going to have a huge uphill battle there Senator.

No one can predict how today will go, there is some hope that since the Senate likes to appear to be the royalty of the Congress, we might avoid some of the circus antics that Saturday in the House brought. It's unlikely anyone will use procedural objections over and over to silence Barbara Boxer or Olympia Snowe.

A health-care overhaul proposed by Senate Democrats will cost $849 billion over 10 years, The Wall Street Journal reported Wednesday, and slash the deficit by $127 billion over the next decade.

The price tag is just under President Barack Obama's target of $900 billion over 10 years.

The estimates, from the Congressional Budget Office, also showed that the bill would reduce the number of uninsured Americans by 31 million people, said the Journal, citing a senior Senate leadership aide.

Senate Majority Leader Harry Reid, D-Nev., has been anxiously awaiting the CBO's price tag for the bill before moving to debate on the Senate floor. The first procedural vote could come later this week on the bill. Obama wants to sign a health-care reform bill before the end of the year.

Like a bill that passed the House on Nov. 7, the Senate's bill aims to cover most Americans, bar insurers from denying coverage to sick people, set up insurance "exchanges" where people can shop for coverage and fine those who don't get insurance. It also sets up a government-run insurance plan, expected to enroll about 6 million people.

But Reid faces a number of hurdles in getting a bill through the Senate, including concerns about the measure's cost. Sens. Blanche Lincoln, D-Ark., and Ben Nelson, D-Neb., are among two of Reid's fellow Democrats who have openly worried about the cost of health-care reform.

Per what I've been told from Senate leadership offices, the Senate health care bill will:

  • cut the budget deficit by $127 billion over 10 years
  • cut the budget deficit by $650 billion in the second decade
  • extend guaranteed coverage to more than 9% of Americans -- including a 31 million person reduction in the uninsured

Reid will probably file cloture on the motion to proceed tomorrow. The CBO's report should go up on the Senate Democrats site shortly.

Chris Wallace on Fox News Sunday asks Sen. Mitch McConnell if the Republicans can prevent the health care bill from coming to the Senate floor. McConnell could not say whether they had the votes to block it from going to the floor for debate, but vowed to stall the bill with "a lot of amendments over a lot of weeks".

Oh boy. I wonder if we'll get to see any Republican Senators using babies as props or similar nonsense as they drag this thing out?

WALLACE: Let's turn to health care reform. Senate Democrats are expected to bring a bill to the floor this week. Do you have the 41 votes in the Senate to prevent them from even bringing it to the floor?

MCCONNELL: Well, what we do know for sure, Chris, is this is a bill that cuts Medicare, raises taxes and raises insurance premiums.

We know it's been in Harry Reid's office for six weeks and the other 99 senators have not seen it. I think we ought to at least have as much time for the other 99 senators and all of the American people to take a look at this bill as Majority Leader Reid has had.

The only way to guarantee that for sure would be to delay the process to allow everyone to fully understand what's in the bill.

And then if there are 60 senators who want to go to this bill, even though the administration's own actuary, somebody who works in the administration, the Department of Health and Human Services, has said that it will drive the cost of health care up and that it will hurt seniors -- if they still want to go to it, then we'll have the debate.

And when we get on the -- on the bill, if we do, there will be a lot of amendments over a lot of weeks. I mean, the Senate is not the House. You saw in the House three votes and it was over in one day.

Look, we spent four weeks on a farm bill in the last Congress, eight weeks on an energy bill earlier this decade. This will be on the floor for quite a long time. I think it ought to be on the floor at least as long as it's been in Harry Reid's office.

The Democratic Party: Still Looking Out for Women's Health!

If only women didn't have those drippy, icky parts that make God-loving conservative politicians so edgy, politicians wouldn't be forced to do things like this to us. But women do have those icky parts, and thus we should understand that our job is to hush up - and be grateful for whatever crumbs we get.

Those crumbs, however, do not include routine gynecological care, nor do they include birth control. (Why am I so convinced that somewhere in this bill, Viagra is covered?)

Thanks, Democrats, for standing up for women - again! So far this week, I've turned down two fund-raising calls for the state and national Democratic party. At first, I was just angry over the Stupak amendment, but now I know I'm going to have to save that money in case I need a gynecologist.

None of the bills emerging from the House and Senate require insurers to cover all the elements of a standard gynecological "well visit," leaving essential care such as pelvic exams, domestic violence screening, counseling about sexually transmitted diseases, and, perhaps most startlingly, the provision of birth control off the list of basic benefits all insurers must cover. Nor are these services protected from "cost sharing," which means that, depending on what's in the bill that emerges from the Senate, and, later, the contents of a final bill, women could wind up having to pay for some of these services out of their own pockets. So far, mammograms and Pap tests are covered in every version of the legislation.

Got that? The Pap test itself will be covered - but not the visit to the gynecologist to get it.

Granted, Congress can't--and shouldn't--get into the business of spelling out every possible cause for a trip to the doctor. No one wants the process to collapse under a mountain of requests from special interest groups à la the Clinton mess in 1993. But women, half of all adult patients, are not a special interest group. And since both the House and Senate bills include lists of specific services that must be covered by health insurance companies and be provided without asking patients for additional money, it's hard to understand why all the services provided in a basic well-woman visit to the gynecologist isn't on them along with maternity care, newborn care, pediatric dental and vision services, and substance use disorder services.

Uh, hello? Remember? Icky parts!

The fault for the initial omission can be laid at the feet of Democrats, who shied away from the issue, not wanting to invite controversy, according to women's health advocates who tried unsuccessfully to get women's preventive health care included in the basic benefits package. Some of the concern had to do with cost. Adding any required service to the basic benefits package would mean the Congressional Budget Office would give the bill a higher score, or price tag, leaving it more vulnerable to attack by budget hawks. But another part of the problem clearly stems from the fact that women's bodies have become political lightning rods, even when abortion is not the issue.

Consider what happened when the subject of women's preventive healthcare services came up in the Senate Health, Education, Labor and Pensions Committee (HELP) in July, after the minimum benefits package had already been determined. Because some essential care for women wasn't included in the list, HELP committee member Senator Barbara Mikulski proposed an amendment that would require the Health Resources and Services Administration (HRSA) to stipulate that basic women's health services would be covered. The language said nothing about abortion, referring only to "preventive care and screenings."

Yet the voting on the amendment went exactly along pro- and anti-choice lines. The amendment passed by just one vote, with all the committee's Republicans as well as Pennsylvania Senator Robert Casey, an anti-abortion Democrat, voting against it. The committee's discussion of the amendment was dominated by Republicans' worry about the possibility of government money winding up in the hands of Planned Parenthood. Since there is no similar language included in the just-released House bill, the only hope for requiring full coverage for these essential services now lies with the Senate.

Good old Bob Casey! He's the same Pennsylvania senator who's now working on the Senate version of the Stupak amendment. (Hey, if you'd like to share your opinion with him, you can call him at 202-224-6324 or toll-free at 866-802-2833.)

While some within the anti-abortion movement have long opposed birth control, there is still widespread support for it among the general public, with virtually all women of childbearing age who have had sex using contraception. So why would senators treat birth control and other basic women's health services as a proxy for abortion? "People equate family planning services with Planned Parenthood, and they equate Planned Parenthood with abortion," says Adam Sonfield, an expert on funding for reproductive health services at the Guttmacher Institute. The senators who turned Mikulski's language into a referendum on abortion "either misunderstood or purposely distorted the amendment."

Such is the intellectual acumen of our elected officials. Either they're really that stupid - or pathological liars. (Or both.)

Either way, the irony of letting anti-abortion sentiment undercut the coverage of birth control is that it will likely lead to more abortions. "If women can't get this kind of primary care, there are three clear outcomes: cancer, abortions and infertility," says Anne Davis, medical director of Physicians for Reproductive Choice and Health, and a practicing Ob/Gyn in New York City. Davis cites the facts that untreated sexually transmitted infections can lead to infertility, and that pelvic exams help diagnose cervical cancers. As for the importance of covering--and not requiring women to kick in additional money for--birth control, Davis says, "It's fundamental primary preventive care. So if we don't do this, we're causing a lot of abortions."

Still, some Democrats involved in the health reform sausage-making process counsel patience. Noting that both Pap smears and mammograms should be covered by a reform bill, Senator Al Franken said, "There's more we need to do for women's health, but this is a huge step forward for American women, many of whom don't get these recommended screenings right now. What we pass may not be perfect, but it will make progress in improving the lives and health of women."

Oh, Al. What would Frannie say? More to the point, what would your daughter Thomasin say?

Yet, before we resign ourselves to a very imperfect health reform bill, it's worth reminding lawmakers that women's health extends far beyond abortion. And while those who make our laws may fear the consequences of taking a stand for basic services for this half of the population, the cost of not doing it, both in terms of health and politics, is sure to be far greater.

As I said, I've already turned down two Democratic fundraising calls this week. I don't know about you, but I'm just not feeling it these days. Why, if I didn't know better, I'd swear the Democratic party just doesn't care about women.


The Stupjack Amendment: Because Every Sperm is Sacred

I want to propose a new amendment be added during the conference committee when the House and Senate get together to merge the health-care reform bills. I know the U.S. Conference of Catholic Bishops will love it, since they are officially members of Congress now. Here it is.

All pro-life male members of Congress who ejaculate without the express intent of making a baby will be considered to have had an abortion. (This will include airport-bathroom encounters.) Under this new rule, the male pro-life members then must fall in line with the same restrictions to health care as women will have to under the Stupak Amendment. Then starting in 2013, all pro-life men in America will be covered under this provision as well.

Remember, sex is for one thing and one thing only. I believe a man has an even greater responsibility than a women does just by the fact that the Congress is made up of mostly men.

Out of the 56 women in the Democratic caucus, only two voted for Stupak. All 17 Republican women voted for it.

What this adds up to is that 97% of the Democrats who voted for the Stupak amendment were male. 90% of the Republicans were male.

I would have to guess that if more than 17% of the congress were women, there would be a little bit less likelihood that women's rights would be so often used as a handy tool to placate neanderthals.

If men want to lead this country in the debate about abortion, then they should show real leadership and take responsibility for their behavior. Are you with me, Bishops? A woman can't just stand around and get pregnant. She needs our seed to be planted in her garden, so why should a woman be held to a higher standard than a man? Is that the democracy and freedom our troops are fighting for?

I'm sure the USCCB will gladly jump on board with this because they are in the sex business and are considered the world's No. 1 experts in that field. They understand better than any living person how a baby is made -- after all, they are Bishops. Imagination is a wonderful thing and can inform and educate people who have never experienced sex. Wow, who knew?

From Alternet--Obama Is Keeping Bush's Worst "War on Terror" Policies Firmly In Place

We know the rules by now, the strange conventions and stilted Kabuki scripts that govern our cartoon facsimile of a national security debate. The Obama administration makes vague, reassuring noises about constraining executive power and protecting civil liberties, but then merrily adopts whatever appalling policy George W. Bush put in place. Conservatives hit the panic button on the right-wing noise machine anyway, keeping the delicate ecosystem in balance by creating the false impression that something has changed. We've watched the formula play out with Guantánamo Bay, torture prosecutions and the invocation of "state secrets." We appear to be on the verge of doing the same with national security surveillance.

Okay, Senate Is Including A Public Option; Now What?

So the pressure we brought to bear on Harry Reid's office over the weekend did have some effect. The bill does have a public option, despite mutterings from unnamed sources that the mythic and coveted 60 votes would be a whole lot easier without the public option. But we're not out of the woods yet, not by a long shot.

Now we get to see the Republicans really ramp up the scare tactics--telling the gullible and easily frightened that this is just one step behind the evil Soviet Empire that St. Ronnie slayed, with its government-run health care, all evidence to the contrary. Up until this point, Obama has kept the Senate dealings at arm's length, a political calculus that made some sense, looking at what happened to Clinton's attempt to get health care passed. But it's going to take some seriously strong political leadership now to make it untenable for any member of the Senate to vote against health care reform. As Mike Lux says, "Game On":

We don't yet know whether we will get the best version of the public option in the House bill, and the Senate version is not as strong as progressives have been pushing for. But strengthening the form of the public option can be negotiated over in conference committee, once we get there.

For now, we can thank Harry Reid (HCAN has a page here) and Nancy Pelosi for their gutsy leadership, and fight like hungry dogs to win the floor fight and deliver on this hope. In the coming weeks we will have an all-hands-on-deck, all out public war with the insurance industry over whether we finally pass comprehensive health care reform or once again fall short at the bitter end after coming so far.

Here's where things are as we head into the floor fight:

1. White House staffers confirmed for me this afternoon that they are backing Harry Reid's decision "100 percent." Now that's not to say they aren't a little nervous about it. I suspect that there are still some feelings by some people working in that building that progressives should have given up and rolled over, and let them cut a deal with Olympia Snowe on her trigger-written-never-to-trigger. That would have been easier than sweating what will undoubtedly be a very tough battle to get all 60 Democrats to go along with the rest of the party. But us irritating progressive folk got in the way of doing that, and now Obama knows it's time to stand and deliver. I believe my friends at the White House when they say they will do an all-out fight for this bill. They know that starting down this path, and not being able to pull it off, would be a huge embarrassment and destroy all the momentum we've built by making it this far. They are all-in, and know how much is at stake. Rahm Emanuel and Jim Messina are famous for twisting arms and doing everything in their power to get the votes that are needed, and now is their time to deliver.

That's where you come in. Progressive Change has a petition for you to sign to ask President Obama to stand firm and fight:

"Every day, insurance companies deny care and let people die. Getting one Republican senator's vote is not worth delaying reform -- too many real lives are at stake. We need you to fight and state clearly that anything less than a strong public option is not change we can believe in."

Go. Sign. Make phone calls. Let your voice be heard.

I've been hearing from my sources that the ConservaDems in the House of Lords (The Senate) would rather have states be able to "opt in," rather than "opt out," of the public option in health-care reform. No matter how you feel about these proposals, the one Ben Nelson supports is a far, far worse plan than the other. Here's what he said on CNN's State of The Union:

KING: If there is a vote and Harry Reid needs 60, have you promised him, even if you disagree with the proposal and might vote no on the proposal, you would give him your vote on the procedural issue?

NELSON: I have made no promise. I can't decide about the procedural vote until I see the underlying bill. It would be, I think, reckless to say I'll support the procedure without knowing what the underlying bill consists of. And it's not put together yet. It's a draft -- it will be a draft bill some time next week, submitted the Congressional Budget Office for the review of the cost. And until I've seen a completed draft...

KING: Well, let me -- let me jump in, can you support...

NELSON: ... I'm not going to...

KING: Can you support a public option where states could opt out so there is a public option in the federal legislation, or will you only support a public option where the state would have to opt in, so there is not a national program already created?

NELSON: Well, I certainly am not excited about a public option where states would opt out or a robust, as they call it, robust government-run insurance plan. I'll take a look at the one where states could opt in if they make the decision themselves.

I understand what the other Senators are trying to do with the opt-out proposal -- which comes down to guaranteeing the public option an uphill, state-by-state battle -- but Ben Nelson in particular continually thwarts every effort to include a robust public option in America. I think he uses health insurance payoffs as a form of roughage to keep his bowels clear. And he still won't say if he'll give us an up-or-down vote. Schmuck.

Nelson must be looking to become a health insurance lobbyists once he leaves the Senate and since he takes the most cash from them---I imagine he has a gig already lined up.


This is infuriating. If there was any doubt in your mind as to whose side the political establishment is on, this should settle it:

An amendment that would prevent the government from working with contractors who denied victims of assault the right to bring their case to court is in danger of being watered down or stripped entirely from a larger defense appropriations bill.

Multiple sources have told the Huffington Post that Sen. Dan Inouye, a longtime Democrat from Hawaii, is considering removing or altering the provision, which was offered by Sen. Al Franken (D-Minn.) and passed by the Senate several weeks ago.

Inouye's office, sources say, has been lobbied by defense contractors adamant that the language of the Franken amendment would leave them overly exposed to lawsuits and at constant risk of having contracts dry up. The Senate is considering taking out a provision known as the Title VII claim, which (if removed) would allow victims of assault or rape to bring suit against the individual perpetrator but not the contractor who employed him or her.

"The defense contractors have been storming his office," said a source with knowledge of the situation. "Inouye either will get the amendment taken out altogether, or water it down significantly. If they water it down, they will take out the Title VII claims. This means that in discrimination cases, they will still force you into a secret forced arbitration on KBR's (or other contractors') own terms -- with your chances of prevailing practically zero. The House seems to be very supportive of the original Franken amendment and all in line, but their hands are tied since it originated in the Senate. And since Inouye runs the show on this bill, he can easily take it out to get Republicans and the defense contractors off his back, which looks increasingly likely."

A Democratic aide on the Hill, also with knowledge of the situation, confirmed the account, as did a source who works on defense contracting matters outside of Congress. "The contractors are putting on a full-court press on this amendment... they are all doing it," said the latter source.
