From Alternet--Obama Is Keeping Bush's Worst "War on Terror" Policies Firmly In Place

We know the rules by now, the strange conventions and stilted Kabuki scripts that govern our cartoon facsimile of a national security debate. The Obama administration makes vague, reassuring noises about constraining executive power and protecting civil liberties, but then merrily adopts whatever appalling policy George W. Bush put in place. Conservatives hit the panic button on the right-wing noise machine anyway, keeping the delicate ecosystem in balance by creating the false impression that something has changed. We've watched the formula play out with Guantánamo Bay, torture prosecutions and the invocation of "state secrets." We appear to be on the verge of doing the same with national security surveillance.

Okay, Senate Is Including A Public Option; Now What?

So the pressure we brought to bear on Harry Reid's office over the weekend did have some effect. The bill does have a public option, despite mutterings from unnamed sources that the mythic and coveted 60 votes would be a whole lot easier without the public option. But we're not out of the woods yet, not by a long shot.

Now we get to see the Republicans really ramp up the scare tactics--telling the gullible and easily frightened that this is just one step behind the evil Soviet Empire that St. Ronnie slayed, with its government-run health care, all evidence to the contrary. Up until this point, Obama has kept the Senate dealings at arm's length, a political calculus that made some sense, looking at what happened to Clinton's attempt to get health care passed. But it's going to take some seriously strong political leadership now to make it untenable for any member of the Senate to vote against health care reform. As Mike Lux says, "Game On":

We don't yet know whether we will get the best version of the public option in the House bill, and the Senate version is not as strong as progressives have been pushing for. But strengthening the form of the public option can be negotiated over in conference committee, once we get there.

For now, we can thank Harry Reid (HCAN has a page here) and Nancy Pelosi for their gutsy leadership, and fight like hungry dogs to win the floor fight and deliver on this hope. In the coming weeks we will have an all-hands-on-deck, all out public war with the insurance industry over whether we finally pass comprehensive health care reform or once again fall short at the bitter end after coming so far.

Here's where things are as we head into the floor fight:

1. White House staffers confirmed for me this afternoon that they are backing Harry Reid's decision "100 percent." Now that's not to say they aren't a little nervous about it. I suspect that there are still some feelings by some people working in that building that progressives should have given up and rolled over, and let them cut a deal with Olympia Snowe on her trigger-written-never-to-trigger. That would have been easier than sweating what will undoubtedly be a very tough battle to get all 60 Democrats to go along with the rest of the party. But us irritating progressive folk got in the way of doing that, and now Obama knows it's time to stand and deliver. I believe my friends at the White House when they say they will do an all-out fight for this bill. They know that starting down this path, and not being able to pull it off, would be a huge embarrassment and destroy all the momentum we've built by making it this far. They are all-in, and know how much is at stake. Rahm Emanuel and Jim Messina are famous for twisting arms and doing everything in their power to get the votes that are needed, and now is their time to deliver.

That's where you come in. Progressive Change has a petition for you to sign to ask President Obama to stand firm and fight:

"Every day, insurance companies deny care and let people die. Getting one Republican senator's vote is not worth delaying reform -- too many real lives are at stake. We need you to fight and state clearly that anything less than a strong public option is not change we can believe in."

I've been hearing from my sources that the ConservaDems in the House of Lords (The Senate) would rather have states be able to "opt in," rather than "opt out," of the public option in health-care reform. No matter how you feel about these proposals, the one Ben Nelson supports is a far, far worse plan than the other. Here's what he said on CNN's State of The Union:

KING: If there is a vote and Harry Reid needs 60, have you promised him, even if you disagree with the proposal and might vote no on the proposal, you would give him your vote on the procedural issue?

NELSON: I have made no promise. I can't decide about the procedural vote until I see the underlying bill. It would be, I think, reckless to say I'll support the procedure without knowing what the underlying bill consists of. And it's not put together yet. It's a draft -- it will be a draft bill some time next week, submitted the Congressional Budget Office for the review of the cost. And until I've seen a completed draft...

KING: Well, let me -- let me jump in, can you support...

NELSON: ... I'm not going to...

KING: Can you support a public option where states could opt out so there is a public option in the federal legislation, or will you only support a public option where the state would have to opt in, so there is not a national program already created?

NELSON: Well, I certainly am not excited about a public option where states would opt out or a robust, as they call it, robust government-run insurance plan. I'll take a look at the one where states could opt in if they make the decision themselves.

I understand what the other Senators are trying to do with the opt-out proposal -- which comes down to guaranteeing the public option an uphill, state-by-state battle -- but Ben Nelson in particular continually thwarts every effort to include a robust public option in America. I think he uses health insurance payoffs as a form of roughage to keep his bowels clear. And he still won't say if he'll give us an up-or-down vote. Schmuck.

Nelson must be looking to become a health insurance lobbyists once he leaves the Senate and since he takes the most cash from them---I imagine he has a gig already lined up.


This is infuriating. If there was any doubt in your mind as to whose side the political establishment is on, this should settle it:

An amendment that would prevent the government from working with contractors who denied victims of assault the right to bring their case to court is in danger of being watered down or stripped entirely from a larger defense appropriations bill.

Multiple sources have told the Huffington Post that Sen. Dan Inouye, a longtime Democrat from Hawaii, is considering removing or altering the provision, which was offered by Sen. Al Franken (D-Minn.) and passed by the Senate several weeks ago.

Inouye's office, sources say, has been lobbied by defense contractors adamant that the language of the Franken amendment would leave them overly exposed to lawsuits and at constant risk of having contracts dry up. The Senate is considering taking out a provision known as the Title VII claim, which (if removed) would allow victims of assault or rape to bring suit against the individual perpetrator but not the contractor who employed him or her.

"The defense contractors have been storming his office," said a source with knowledge of the situation. "Inouye either will get the amendment taken out altogether, or water it down significantly. If they water it down, they will take out the Title VII claims. This means that in discrimination cases, they will still force you into a secret forced arbitration on KBR's (or other contractors') own terms -- with your chances of prevailing practically zero. The House seems to be very supportive of the original Franken amendment and all in line, but their hands are tied since it originated in the Senate. And since Inouye runs the show on this bill, he can easily take it out to get Republicans and the defense contractors off his back, which looks increasingly likely."

A Democratic aide on the Hill, also with knowledge of the situation, confirmed the account, as did a source who works on defense contracting matters outside of Congress. "The contractors are putting on a full-court press on this amendment... they are all doing it," said the latter source.


The House of Lords

My pal Jonathan Schwartz comes up with a gem of a quote from James Madison, as he explains why the House of Lords (The Senate) was created in the first place.

And James Madison explaining more than 200 years ago why the Senate would naturally represent the interests of rich people:

Should experience or public opinion require an equal & universal suffrage for each branch of the Govt., such as prevails generally in the U. S., a resource favorable to the rights of landed & other property, when its possessors become the minority, may be found in an enlargement of the election districts for one branch of the legislature, and an extension of its period of service. Large districts are manifestly favorable to the election of persons of general respectability, and of probable attachment to the rights of property, over competitors depending on the personal solicitations practicable on a contracted theatre. And although an ambitious candidate, of personal distinction, might occasionally recommend himself to popular choice by espousing a popular though unjust object, it might rarely happen to many districts at the same time. The tendency of a longer period of service would be, to render the body more stable in its policy, and more capable of stemming popular currents taking a wrong direction, till reason & justice could regain their ascendancy.

Say what you want about the founding fathers, you can't claim they weren't up front about what they were doing.

So you see why the Senate acts entirely against the interests of ordinary America.

From CNN Ensign says he did not breach ethics rules:

Embattled Republican Sen. John Ensign told CNN Tuesday he did not break Senate ethics rules by helping to secure a lobbying job for the husband of the woman he had an affair with.

"I think it's pretty clear. I said in the past, I recommended him for jobs just like I've recommended a lot of people," Ensign told CNN senior congressional correspondent Dana Bash and congressional producer Ted Barrett. "But we absolutely did nothing except for comply exactly with what the ethics laws and the ethics rules of the Senate state. We were very careful in everything that we did. You can see our statements on that."

The comments come four days after The New York Times reported the husband of the woman Ensign had a affair with, Doug Hampton, has since lobbied the Nevada senator on behalf of his clients. The New York Times also reported evidence that suggests Ensign played an active role in getting Hampton the lobbying position. Hampton, a former senior aide to Ensign, is barred by congressional ethics rules from lobbying his old boss for one year after leaving his post in the Senate.

While Republicans continue to distace themselves from the Senator, it appears he still may have one friend in Nevada--Harry Reid-- who continues to call the Ensign scandal a 'personal matter'. Time to end the 'gentlemen's agreement' Senator Reid.

The New York Times revealed that Sen. John Ensign may have ignored laws when giving preferential treatment to a lobbyist that was the husband of his former lover. Fellow Republican Senator Jon Kyl refused to defend Ensign when given a chance Sunday.

Another Republican Senator, Tom Coburn, was caught lying about his role in negotiating payments to the family of Ensign's mistress.

Sen. Barbara Boxer confirmed that the Senate Ethic Committee had opened an investigation into Ensign's actions. "We will look at all aspects of this case, as we do whenever there is a case before us, and try to get to the bottom of it as quickly as we can in fairness to all," Boxer told CNN's John King.

This is quite a change from the days where the Republicans were threatening to blow up the Senate filibuster rule isn't it?

MATTHEWS: Senator Orrin Hatch of Utah. He is a member of the Senate Finance Committee.

Well, there is Senator Schumer putting the best face on a 13-10 loss. Three Democrats joined your party in opposing a public option. Five Democrats joined you on another vote. Where does it stand, the public option, right now?

HATCH: Well, it‘s going to be very difficult. Look, the Democrats are going to do everything they can to pull every trick they can to try and get all of the Democrats lined up to go with a public option.

But, look, if you pass a health care bill that involves one-sixth of the whole American economy and you don‘t get at least 70 votes, meaning bipartisan votes, you‘re not doing what‘s right for the American people. And I can tell you right now, Doug Elmendorf said that it‘s virtually next to impossible to be able to have a public option which would be a level playing field.

There‘s no way it would be level, and that‘s one of the problems. And I think the people out there realize that. And they also realize that you know they promised the same level playing field for Medicare back in 1965. It wasn‘t long until they realized they couldn‘t keep up and had to start setting prices.

Today Medicare pays less than 20 percent to doctors, less than 30 percent to hospitals, and by the way, Medicare‘s $38 trillion in unfunded liability, that‘s what you get when you just have the federal government involved.

These are Democrats
, mind you. And the thing is, I don't even believe most of these amoral jerks give a damn about abortion. They're just playing to their audience, and it provides protective cover for their real agenda: Stop the public option at any cost.

And of course this means that women on Medicaid who already have abortion coverage would lose it. Our women's-rights president's bold stand?

"‘Look, try to get this thing worked out among the Democrats. We want you to work it out within the party,’ ” Mr. Stupak said, adding that Mr. Obama did not say whether he supported the segregated-money provision or a more sweeping restriction. “We got his attention, which we never had before.”

Isn't that nice. In a country founded on religious freedom, apparently some religions are much more equal than others:

WASHINGTON — As if it were not complicated enough, the debate over health care in Congress is becoming a battlefield in the fight over abortion.

Abortion opponents in both the House and the Senate are seeking to block the millions of middle- and lower-income people who might receive federal insurance subsidies to help them buy health coverage from using the money on plans that cover abortion. And the abortion opponents are getting enough support from moderate Democrats that both sides say the outcome is too close to call. Opponents of abortion cite as precedent a 30-year-old ban on the use of taxpayer money to pay for elective abortions.

Yes, God forbid that an unemployed couple who are struggling to get on their financial feet have abortion as an option. It makes a lot more sense to send them (and their offspring) further down the financial hole, don't you think?

Abortion-rights supporters say such a restriction would all but eliminate from the marketplace private plans that cover the procedure, pushing women who have such coverage to give it up. Nearly half of those with employer-sponsored health plans now have policies that cover abortion, according to a study by the Kaiser Family Foundation.

The question looms as a test of President Obama’s campaign pledge to support abortion rights but seek middle ground with those who do not. Mr. Obama has promised for months that the health care overhaul would not provide federal money to pay for elective abortions, but White House officials have declined to spell out what he means.

Democratic Congressional leaders say the latest House and Senate health care bills preserve the spirit of the current ban on federal abortion financing by requiring insurers to segregate their public subsidies into separate accounts from individual premiums and co-payments. Insurers could use money only from private sources to pay for abortions.

But opponents say that is not good enough, because only a line on an insurers’ accounting ledger would divide the federal money from the payments for abortions. The subsidies would still help people afford health coverage that included abortion.

You know what I see as the real issue? When we give high-quality, subsidized insurance to allegedly "pro-life" politicians, why, that means they have that much more cash to spend on their girlfriends' abortions (not to mention hookers of either gender), and that can't be allowed to stand.

The solution is obvious. Just to make sure we're not subsidizing immoral behavior, we need to stop paying for their health insurance. In fact, maybe we should cut their salaries so they're not led into temptation.


Michael Moore Smears Chris Dodd

I haven't seen Michael Moore's new movie, but Howie Klein has, and while he praises it, he excoriates Moore for dredging up the discredited Chris Dodd Countrywide story, which has been picked over to death, with nobody finding any impropriety.

First, everyone who has seriously looked at the claims of a sweetheart deal has dismissed them: the Senate Ethics Committee; an independent compliance firm; the (not exactly Dodd-loving) Hartford Courant. And not once, but twice.

This is not the definition of the word "is." The man got a mortgage. He was told that he would get enhanced customer service, and assumed it was because of his good credit score. He got the exact same mortgage rate that anyone else buying a mortgage at the time would have gotten. He didn't know the CEO of Countrywide, nor anything about a Friends of the CEO program [...]

Why does this feel like, in the interest of being able to sit on Leno and say, "I went after Democrats too!," Moore passed up the real story here? It would have been really powerful if he made the connection between the bullshit allegations about Dodd and the banking industry desperately wanting to put the breaks on important housing and foreclosure legislation that Dodd was championing in the Senate at that very moment. Well, mission accomplished assholes, excuse me, the Sheriff is here to foreclose on my house (is it possible its the same one from Roger and Me? Oh, the irony) [...]

All in all, still love Moore, still want everyone to see the movie, but kind of wish he hadn't decided to jump ugly with one of the most progressive Senators in the Senate -- the guy responsible for the Family and Medical Leave Act, the Credit CARD Act, who voted for cramdown, worked to make that disaster of a bankruptcy bill better, then voted against it twice, voted for a 15% cap on interest rates, and is co-sponsoring another cap that is likely to come up again, is a leader on direct-student-loan reform, is in favor of a consumer financial protection agency and stripping the fed of some of its regulatory authority, and just last week introduced legislation to reign in the diabolical overdraft fee practice-- all stuff, if you are keeping score, which Moore clearly wasn't, that banks would rather paint a hammer and sickle on their walls than accept! I wish Moore hadn't got played like a three dollar harmonica. He should donate the 10 grand to Dodd's campaign.

It appears that the premise of Moore's film is that banking interests have taken over the government and prevented any meaningful regulation on the industry. Dodd's case can be an example of that, but not in the way Moore thinks. The banking lobby has consistently kneecapped him, with old charges that have a Whitewater quality to them, with all the same innuendo and the same lack of factual detail, right at the moments when Dodd was trying to get things passed to crack down on them. Dodd could have given away the Banking Committee Chair to completely-in-the-pocket Tim Johnson, but he didn't. And in the last few days, Dodd has introduced the aforementioned legislation to end the practice of banks charging overdraft fees on debit cards automatically, with 1000% interest, instead of giving customers the opportunity to have a transaction denied; introduced a plan for a single bank regulator that is at odds with the Obama Adminstration and his House counterpart Barney Frank, as well as being hated by the banking industry; and has taken the lead on weakening the power of the Fed, which is deeply desirable. In other words, despite the many slings and arrows, Dodd is basically doing the job Michael Moore would expect someone in his position to do, and doing it with gusto. He should be commended and not smeared.


The Liberal Majority and How To Win With It

One constant theme which needs dealing with is the idea that the country is more conservative than liberal and that centrists are needed to hold off horrible conservative things from happening.

More than that, this is an argument for oligarchy. What I see is that the majority of people, in poll after poll, want single payer. A huge majority want the public option, yet odds are decent you won't even get that.

When people talk of left-center coalitions the center part include a large number of Senators (like Diane Feinstein) who won't do what the majority of their constituents want them to do. At this point centrist = captured by monied interests.

Odds are if Obama wanted single payer, the House could pass it. It'd be close, but they could get it done. The House is the more representative body of the two bodies, the Senate is deliberately retrograde.

When I look at the US what I see is a banana republic, because it doesn't act like a democracy. I see people who think that the Senate, or even the House, actually does what the American people want. Again and again, Congress does things that the majority disagree with. In 2006 the Dems were elected to end the war in Iraq, for example, and refused to do so (though again, the House at least went through the motion, the Senate didn't even make an effort). Oh, Congress will sometimes do what the majority want—when that's what it was going to do anyway.

The plan to fix this is simple enough and always has been.

Funny, I don't remember any Republicans saying this when they wanted to get Bush's judicial nominations through the Senate.

HANNITY: And that was Senate Finance Committee chair Max Baucus earlier today making a plea on behalf of his health care reform plan. Now we had hoped and, in fact, promised it would be a bill that would garner bipartisan support. Instead, Senator Baucus, he found himself standing all alone this afternoon.

There were no Democrats. There were no Republicans by his side. So, is his bill DOA, dead on arrival? We're joined now by former White House communications director Nicolle Wallace and Sandra Smith from the FOX Business Network.

You know, the interesting part of this is nobody came out with him. It's still going to be $800 billion. Still hasn't been scored. But you got Rockefeller saying no, Wyden saying no. That's on the Senate side. And then Olympia Snowe saying get rid of the government option.

You have Weiner in the House. Pelosi in the House and the CBC in the House saying no way without a government option. It's the Democrats' problem.

NICOLLE WALLACE, FORMER WH COMMUNICATIONS DIRECTOR: Yes. Look, I think what we'll never know is how this would have played out if this is where the Democrats started. You know the one thing I thought today was this would have been a great opening position if the Democrats had spent the last four months trying to rally support around this as their position to come to the table and invite Republicans to sit down with them.

This is the best we can do. We think this represents the desires of most -- many Americans.

HANNITY: Right.

WALLACE: What do you have? But, you know, instead, this is near the end of the process and he walked out alone.

SANDRA SMITH, FOX BUSINESS NETWORK: And the whole point here is that the proposal -- we understand that this is a proposal. This is not the actual plan. It's a mark up. It can be changed. It will be changed. But the whole point, Sean, is that he was coming out with this in hopes of garnering Republican support. He steps out today. He is alone. No one is joining in with him.

HANNITY: Not one person.

SMITH: Not one person.

HANNITY: Well, Harry Reid, for the first time this week, said he will use the nuclear option. If he goes down that road, what will the reaction be not only from Republicans but from people in this country that are out there protesting at town halls, the march on Washington this week. What's the reaction?

WALLACE: I think the nuclear option is the only thing less appealing to the American people than the public option. I mean you saw the outcry. We all saw over the summer. This is not a Republican revolt. This is a revolt of the American people. And I think if he turns to that tactic, I think the Democrats will pay hefty price.

And of course she's wrong about support for the public option.

Chris Matthews talks to the AFL-CIO's Richard Trumka about the need for at minimum to have a public option in the health care bill. Trumka does a great job despite Matthews' badgering and taking a shot at union members by asking him if they're going to "pummel" (Democratic Senators who won't go along) during the interview. Way to advance that "union thugs" meme there Chris.

Matthews: Can you pass a bill like that?

Trumka: Absolutely.

Matthews: How?

Trumka: We’re working on it.

Matthews: Where are you going to get the votes in the Senate?

Trumka: Well I think the President coming out helps us.

Matthews: You think you can get sixty votes in the Senate?

Trumka: I do.

Matthews: Where? Name the Republicans. Name one Republican.

Trumka: Snowe.

Matthews: Okay, name another one.

Trumka: Well, we don’t need another one do we?

Last night on Countdown, Eugene Robinson and Keith Olbermann agreed on the risks for Obama: If he doesn't come up with a viable public option, he will very likely face a challenger in the Democratic primary.

Olbermann: But what about the risk of passing some sort of interim measure here and we hear Congressman [Raul] Grijalva, who's the head of the Progressive Caucus having released a statement last night about grave concerns about these contacts supposedly from the administration to health care reform advocacy organizations they are going to cease supporting the public option. What good does it profit a man to win a bill and lose the base of his party?

Robinson: In the medium term and in the long run it doesn't strike me as a great idea. I mean look, you could say okay, this is the best bill we can get. Is the liberal Progressive Caucus going to thwart what is possible in search of the perfect? And so you could put them in that position and you could maybe wrestle them into going along with what they consider a bad bill, but there's a lot else on the table. He's, our involvement in Afghanistan is deepening, we're talking about Iraq, we're talking about Guantanamo. We're talking about a lot of issues on which the Progressive Caucus is going to have a lot to say and I don't think you want them to be in a foul mood.

Olbermann: No, no, no because he's compromised on everything so far and as self defeating as it might be, the Progressive Caucus and progressives would abandon him if necessary if this were to be the policy of this administration into 2012. If it's necessary to find somebody else to run against him, I think they'd do it no matter how destructive that might seem at face value.

Robinson: Well, I think that is possible. We are a more polarized nation right now and I think searching for a mythical center, a mythical compromise between doing something and doing nothing, ah... there's nothing in the middle there, you know. Either you're going to do something or you're not and I think you've got to choose.

Olbermann: The middle has been nothing all this time. This is just a different variant of it.

Meanwhile, the House Dems' Progressive Caucus has fired a return shot across the bow. Last night they delivered a letter to the White House: Not only will they not support a House bill, they will not vote for the final bill without it and asked for a meeting with the president:

We continue to support the robust public option that was reported out of the Committees on Ways and Means and Education and Labor and will not vote for a weakened bill on the House Floor or returning from a Conference with the Senate.

Any bill that does not provide, at a minimum, a public option built on the Medicare provider system and with reimbursement based on Medicare rates-not negotiated rates-is unacceptable.(...)

A health reform bill without a robust public option will not achieve the health reform this country so desperately needs. We cannot vote for anything less.

To date, only six members have signed. If they get to 40, we have a very different ballgame.


Good Bushie Curt Schilling Eyes Run For Ted Kennedy's Senate Seat

It doesn't happen often, but when the sports world collides with politics, it's worth noting -- especially when it's an athlete who was a staunch support of both George Bush and John McCain, eying Ted Kennedy's vacant Senate seat:

BOSTON -- Curt Schilling, the former major league pitcher who won the allegiance of Bostonians by leading the Red Sox to the 2004 World Series, said Wednesday that he has "some interest" in running for the seat held for nearly 50 years by Democratic Sen. Edward M. Kennedy.

Schilling, a registered independent and longtime Republican supporter, wrote on his blog that while his family and video game company, 38 Studios, are high priorities, "I do have some interest in the possibility."

The 42-year-old lives in suburban Medfield and campaigned for President George W. Bush in 2004 and Sen. John McCain in 2008. Read on...
