From AC360 Sept. 10, 2009. While discussing Rep. Wilson's outburst during the President's speech, Tea Party oganizer Mark Williams says this about illegal immigrants receiving health care benefits:

WILLIAMS: Everybody seems to be leaving one very important thing out of this. And that is, the federal courts have spoken with regard to illegal immigrants or illegal aliens getting benefits, especially health benefits. We tried to bar them from doing that in California back in the '90s, and the federal courts slapped us down.

Even language specifically excluding them is not going to stand a court battle. So, whatever Obama believes -- and, for that matter, I don't even know what bill he was talking about. Does he have a proposal? Does he have a plan? What's he even talking about?

He and Roland Martin get into it in the above segment after the commercial break where Williams reiterates what he said about the courts, and Martin insists that there are no provisions for illegal immigrants to receive benefits in any of the proposed health care legislation.

Dave Neiwert gave me his slant on this:

Illegal immigrants entering an emergency room for treatment will be covered under any health-reform plan – because they are already. It’s a basic legal matter that emergency rooms cannot turn away anyone in need of emergency care. The courts have indeed decided this. The question is, does Mark Williams want it otherwise? Does he want emergency rooms deciding who lives and who dies depending on their ability to prove their citizenship? Does he want people to die on emergency-room doorsteps because they are undocumented?

Undocumented immigrants get no insurance benefits under the Obama plan, but the costs of their care will be covered under a more sane system. The taxpayers will wind up covering the costs, as they do now, but the costs should be less because the payment system will be more direct.

Those are the questions Roland Martin or anyone on that panel should have been asking Williams, but I guess that's expecting too much of CNN. I also would have liked for one of them to ask Williams if he thinks going to an emergency room is the equivalent of having health care coverage as I've heard one too many Republican member of Congress assert.

BLITZER: Let's get back to our panel talking strategy on health care reform and Congressman Joe Wilson's outburst, CNN's Candy Crowley joining us, political contributor Roland Martin, and Tea Party Express organizer Mark Williams.

We're going to get what Dana just reported. But, Mark, I want to give you a chance to respond to what Roland said, that John McCain himself agrees with the president that nothing in this legislation would give illegal immigrants in the United States the opportunity to gain from this proposed legislation.

WILLIAMS: Well, Wolf, it doesn't have to, because the courts have already spoken on. And that they will speak again if -- if -- if it happens.

But this bitterness that supposedly is directed toward Obama, if I have learned anything in my work with OurCountryPAC.org, it's that it's not bitterness. It's outrage at the socialist policies being embraced by this administration.

MARTIN: Nonsense. It's bitterness.

WILLIAMS: And that goes -- that goes double for W., by the way.

And, as far as the Republican Party goes, it's no surprise to any of us working stiffs out here that they allow themselves to be a doormat for what is happening in Washington, D.C.

The fact of the matter is, the Republican Party, as a whole, is absent without leave from this debate. And our representatives, our elected representatives, are falling down on the job of upholding and protecting the Constitution. And that's why the American people are rising.

That's why I had almost 10,000 people outside Chicago at our tea party the other day. People are sick and tired of being abused and then being called a mob of Nazis because they object to that.

BLITZER: All right.

WILLIAMS: We're the people who pay the bills.

BLITZER: Roland...

MARTIN: Wolf, here's the deal.

BLITZER: ... let me bring you into this conversation.

You just heard what Dana reported, that moderate Democrats are encouraged by what the president is saying. But here's the question to you. Will these liberal members of -- of Congress go ahead and support legislation if it doesn't include the public option?

MARTIN: Look, I think the liberals and the moderates are going to have to give on the issue. But the most important thing is, they recognize they're going to have to get health care reform. The Democrats, this is in their plank. It has been in their plank for a number of years.

There is no way in the world that they are going to allow that this moment, when they're so close, to slip through their fingers, because they cannot blame the Republicans. They will have to accept the blame themselves. Democrats control the House, control the Senate, control the White House. They can't look to anybody else.

They have got to suck it up, come out, pick out their differences to move it forward.

BLITZER: Candy, the political reality is, the president does have decisive majorities in both houses of Congress. In all likelihood, he's going to get what he wants, but not necessarily the public option, right?

CROWLEY: The public option is the one thing that even people at the White House have looked at and thought that perhaps it will have to go.

Much depends on what happens in the Senate. But it is a lot easier to see most of the liberals swallowing this and saying, OK, no public option this go-around, maybe we will see down the road if we need one, than it is to see conservatives and moderates accepting it. It just isn't going to happen.

BLITZER: Mark, is there anything...

CROWLEY: So...

BLITZER: ... your organization likes about the plans that the president is putting forward?

WILLIAMS: No. Where is the tort reform? Where is -- where is that at? That's the real problem. He doesn't want to take on the trial lawyers.

BLITZER: Well, he did say last night that he...

MARTIN: Wow. Nothing.

BLITZER: ... he would let a test go forward on -- on caps on medical malpractice.

WILLIAMS: Well, that doesn't help the tort reform. That doesn't do anything but -- but hurt me if I'm butchered by somebody not being able to be made whole.

No, he's taking us down a $9 trillion deficit path here that we have no business walking down. We have serious problems in this country.

MARTIN: So, Mark -- Mark...

WILLIAMS: We're in an economic -- we have economic issues. We have social issues. We have international issues. We're -- we're having problems in Afghanistan now.

All of these are major priorities. And this administration is watching its approval ratings drop through the 50s and eventually into the 40s, where it won't be able to accomplish anything. And it needs to accomplish much.

MARTIN: Mark, there's nothing in -- Mark, there's nothing in the bill?

Are you are telling me that you have a problem with the president saying that, if you have a preexisting condition, you're going to now get covered? You don't like that?

(CROSSTALK)

WILLIAMS: If I'm -- yes, I will find an insurance company that will cover me. I'm sure that was...

(CROSSTALK)

MARTIN: You're not going to find them, Mark. They're not going to cover you.

WILLIAMS: Well, there is probably a good reason, because it's a bad risk.

MARTIN: Wow.

WILLIAMS: And if he's going to come to me and tell me that I must have insurance, or I'm committing a crime, and then fine me, I don't think so. We all have a right to health care.

MARTIN: Mark, I want you to admit...

WILLIAMS: I have also got a right to a gun. I'm not going to give him to $1,000 for a Glock.

MARTIN: Mark, I want you to admit...

WILLIAMS: I have got a right to free speech, but they're not telling me what to say and how other say it, are they?

MARTIN: So, Mark, if your wife got sick and had a preexisting condition, and the insurance company turned her down, you would say, you know what, honey, guess what, they need to make money, it's a smart move?

You would accept that?

WILLIAMS: If somebody has a record of DWIs, can they still get car insurance someplace?

MARTIN: No, no, no, answer my question, Mark.

WILLIAMS: I'm answering your question.

MARTIN: If your wife had a preexisting condition...

WILLIAMS: In the private sector, where competition reigns...

MARTIN: It's amazing.

WILLIAMS: ... a company would emerge that would take on those high-risk cases.

BLITZER: All right, guys, unfortunately, we have got to leave it to rest there.

MARTIN: They don't exist now.

In a Defense Science Board Report from a few years ago, it states that the present system in America would not be able to handle any type of pandemic health crisis under its current state of affairs.

The Defense Industry is concerned that a health crisis would seriously impact the national security of the United States. So, this issue of pandemics that you talk about is nothing to laugh at, whatsoever.

The repugs complain that Obama hasn't listened to their plans. However, he has listened to them, and he doesn't agree. He obviously has listened to them on the tort reform issues because he mentioned it in his speech; nevertheless, he said he would order Sebilius to test caps on medical malpractice, even though he disagrees it would help.

He obviously has listened to the portability, across state lines issue because I've seen Axelrod explain that this is a very difficult issue.

Obama has listened to their proposals; the fact is, he disagrees with them, and he won the election.

The repugs in particular want a bill on their terms only. They want only a bill that exclude things that Democrats want. The repugs lost the last election. Obama won. Why is it that the Democrats have to give up more and more to satisfy these repugs?

So how do you determine who is legal and who isn't before they are treated in an emergency room? If a person is brought unconscious into an emergency room, do you make him wait to be treated until he can produce proof of citizenship? Do we make all illegals sew a big letter I on their clothing? How do you enforce that? Do we make everyone carry a national id card? I thought conservatives didn't like that idea. The level of insanity on the right is unbelievable.

I guess it would leave out any unconscious so everybody (unless you're lilly white) has to wait until they are able to talk and explain themselves.

I have talked to several people who manage apartment buildings and know hire undocumented workers. I asked them why they are doing something they know is illegal. Their response was as long as an undocumented worker produced a social security number that is all they needed because there is no standard procedure to determine whether or not a social security number is legitimate. Look how long Republicans had control of Congress and did nothing to address immigration reform or health insurance reform. The corporatocracy has no problem with illegal immigrants because they profit off them by not having to pay a living wage. Further, immigrant workers DO pay into Social Security BUT they are not privy to social security. Another cash incentive for the corporatocracy to do nothing about illegal immigrants.

Republicans love a wedge issue to divide the people.

a local ER here a few nights ago with gunshot wounds of various magnitudes and they were not denied treatment. The police arrived quickly though to take them into custody after what was a shootout between rival gangs.

I guarantee you that the people who knowingly employ illegal labor are not limited to the Republican party. The industries that rely on illegal labor are too large not to have some Democrats engaged in the same behavior.

I agree with you, though, that if we were to eliminate illegal jobs, illegal labor would not be present in this country to fill them.

Given that many, if not most, of the people against illegal labor are also against unions and make no effort to enforce labor laws to get rid of illegal jobs, I wonder whether all of this hysteria is aimed at making the undocumented worker even more invisible and at the mercy of the illegal employer. Perhaps the Williams' of the world are just trying to erase the distinction between illegal labor and slave labor.

About a year ago, a homeless illegal immigrant came into the ER at the local hospital experiencing chest pains. He spoke no English and he smelled bad. He obviously had no insurance. So he was turned away by the doctors.

He then walked out on the front lawn of the hospital and died of a massive heart attack. That is where he was found dead.

I remember this story: it brought me to tears. And now to hear this shit faced mother fucker talk makes my blood boil.

We are all culpable in murder and there is blood everywhere.

so, we turn undocumented people (illegal aliens, tourists who aren't carrying their passport, americans without ID, etc) away from ERs across the country... but, what our dear friends in the eat-shit-and-die party have yet to address, and what will soon be a problem if they are able to enact their people-hating policy, is: what do you do with all the people who die in front of the ER b/c they are denied care?

I say that the GOP (along their dem allies) and their corporate paymasters need to start formulating policy that addresses:

1) what to do with the dying people in front of the ER

2) how to fine/imprison those that have died in a non-dying zone.

3) how to frisk someone who is severely burnt, and/or unconscious, or a baby for proper ID. with the back of the hand?

where to you do with an undocumented person, man, woman or child, if they have Swine flu, or hepatitis? Just send 'em back into the general population? Have the arrested and put in jail?

Look at Texas as an example of tort reform and the effect it had on malpractice insurance rates. Texas enacted caps on malpractice suits in 2003; there are virtually no malpractice cases there anymore yet malpractice insurance rates have failed to go down-they have in fact gone up. Kindly explain how tort reform will affect health insurance affordability if the insurance companies simply pocket the savings.

Malpractice costs, btw, are less than 2% of the overall healthcare cost. And guess, who sells the "malpractice insurance" to the docs?

Do insurance companies have the right to decline coverage for a doctor who has a record of malpractice losses?

Do insurance companies have the right to tell patients they cannot be treated by a doctor with a record of malpractice?

... but technically, the HMO can use the doctor's malpractice record during the contractual negotiation (if it is a private practice for example).

They may use the doc's malpractice record as an excuse to deny out-of network claims, for specialists at least. Truth is that HMOs have an incredible latitude when it comes to deny claims (and that goes for Doctors too, the HMO can technically refuse to reimburse the procedure for whatever reason, even after the procedure has been performed). They also have to provide little in terms of justification of why the claim was denied.

Malpractice is not that big of a deal for most HMOs, because a lot of the burden is put on the physicians, hospitals, and clinics... which are required to carry pretty hefty malpractice insurances.

the docs themselves can be cut from being insured due to their past incompetence, or if they just have to pay higher rates.

My question related to the insurance companies screening out bad docs for their policyholders is really one designed to raise the issue that eventually even doctor's ability to practice will be determined by insurance bureaucrats.

... either malpractice insurance will jack up their rates, or no insurer will cover them and then their employing hospitals/clinics may kick them (doctors with too many malpractice loses) out. Besides malpractice, there are other metrics doctors have to meet (successful operation in the case of surgeons for example, average patient stay, deaths during operation, etc) and which can also be used by insurers as an axe of sorts.

The docs ability to practice is determined by bureaucrats from the get go, not just via malpractice insurance. A lot of procedures have to be cleared by the insurance for the doctor to go ahead and proceed with them. And even if the procedure is approved, it is not guarantee the doctor's office won't have to go through endless hoops to get the insurance to pay for them. It is truly a magnificently inefficient system.

It is not just patients who have to go through endless hoops to get their claims serviced, but also the doctor offices/hospitals have to go through a big deal of paperwork/negotiation to get the insurer to cover/refund/pay for the cost.

Provide healthcare for everyone in the country and then use immigration law reform to solve the illegal immigration problem.

I've been thinking that maybe Osama Bin Laden should have formed an insurance company. That way he would have a license to kill Americans and no one would care. That IS what the insurance companies have now isn't it? A license to kill? It's time to put a stop to this BS now.

As cruel as his opinions are, anti-immigrant attitudes have a lot of traction with Americans these days. Americans continue to decry undocumented immigrants as "illegals," as though there's something innately criminal about them, and Americans completely ignore the police sweeps of immigrants, unprecedented in scope and severity, that have gone on in this country for the past couple of years, with many immigrants held in cells for months without charge. Apparently Americans support this sort of thing. It's sick.

An illegal immigrant is here illegally, true, but the richest country in the world can't reject health care and let someone die, we simply can't do it. It's wrong. Save their life FIRST and worry about the legal/financial consequences later.

Over at the InsWeb Blog, we discuss health insurance woes quite frequently. But I've never heard someone come out against care for uninsured who visit emergency rooms. What does he expect hospitals to do, send them out to the gutter to bleed to death or drop dead from a heart attack? That's insanity, and frankly it's disgusting.

The stupidity of Williams, and of Anderson Cooper for even considering having him on CNN, is that if indeed we start denying care to ANYONE, we will see a tremendous increase in communicable diseases like drug resistant TB, H1N1, hepatitis A, and food borne illnesses in food service workers.

You can't use insurance as a device to provide for the public's health. It works for business ventures, even driving a car. Americans should not accept that an underwriter making a business decision is willing to let someone die because they couldn't make money off the venture.

I'm pretty sure that any physician who's taken the hippocratic oath would find it hard to deny care to sick people, as would nurses or anyone else with a heart. These people obviously don't have a clue as to what kinds of illnesses and injuries are seen in emergency rooms.

Two years ago my family was visiting Guanajuato, Mexico, and my son got very sick. We walked a block to a medical clinic to seek help. Within an hour, he had been seen by a doctor, had tests run and diagnosed with a rather serious parasite, and been given medication. Cost: $60.
A couple of days later, my wife also got sick and we did the same procedure (she just had the usual "tourista"). Cost: $60.
When we returned to Texas we checked in with our regular doctor. He told us that the Mexican medical team did everything exactly right, exactly what he would have done.
I'm sure glad the Mexicans are good, caring people who wouldn't turn away strangers who hadn't paid into their system.
