Rachel Maddow Corrects Rep. Schock's Talking Points on Terrorists Being Read Miranda Rights
Like I said, if MSNBC cared about their ratings, Rachel Maddow would be hosting Meet the Press. Here she does David Gregory's job for him and corrects Rep. Aaron Schock for repeating the talking point that Umar Farouk Abdulmutallab quit talking after he was read his Miranda rights and she points out that this was not an issue until a Democratic administration took office.
MR. GREGORY: Are Republicans and Republican attacks against this administration helping al-Qaeda?
REP. SCHOCK: Absolutely not. And I think it's insult to most Americans to suggest that their elected representatives who are carrying their views and the message of, of the majority of Americans to Washington and to this debate are somehow helping al-Qaeda. Mind you, these are the--many of these Democrats, including Mr. Brennan who served in the last administration, faced many of these same attacks under then-President Bush from, from the left. So the idea that we can't challenge the administration and their view on the fight on terrorism is completely bogus.
MR. GREGORY: What happened to Democrats when they challenged President Bush in the same way?
REP. SCHOCK: Well, some of the same, some of the same claims were made against them.
MR. GREGORY: Right.
REP. SCHOCK: But at the end of the day, we're representing mainstream America and the majority of views. And, and whether it's closing Guantanamo Bay and moving it to the heartland of America, whether it's the, the--trying these folks in downtown New York, whether it's Mirandizing terrorists who come to this country to attack us, the majority of Americans have not bought, do not believe that Obama and his administration is right on these policies.
MR. GREGORY: So you don't support the way the president is prosecuting the war on terror?
REP. SCHOCK: No.
REP. FORD: I, I, I, I can appreciate the, the politics that are at play here, and we're heading into a cycle, and we just met. I think he's a nice guy and a good guy, but to suggest that this administration is not focused in a right way and determined to keep America safe I, I think is just, is, is just not right and foolish. I think there's a legitimate conversation about whether Khalid Sheikh Mohammed should be tried in my home city. I disagree with the administration, I'm glad now we are revisiting and looking at a different location. I was against it because I think the costs are too high. We're in the middle of a recession. It would cost some $225 million a year to try him there. We could spend that money in a jobs program, an education program or even to pay down the debt. But to suggest--to play politics at this moment--Democrats raised the same concerns when Bush was in office and the same answers were given and--some similar answers were given by Republicans. The truth of the matter is Congress and the Senate ought to be focused on our efforts in Afghanistan, Iraq, and ensuring that our AfPak policy works. The conversation around Pakistan and Kashmir and whether or not a resolution there will help us resolve our issues in Afghanistan are far more important than a volleyball going back and forth about who's at fault. Barack Obama and his administration deserve tremendous credit for what they've done up to this moment.
MR. GREGORY: All right. Quick, quick comment, then I want to move it to domestic matters.
REP. SCHOCK: First of all, I want to make it clear: Nobody's suggesting that President Obama and his administration don't want us to be safe. What we're suggesting is he's taking unnecessary risks.
MS. MADDOW: Well, well, can I just...

Nobody's ever made an issue of it until the Obama administration and this case with Abdulmutallab. Literally, what's, what's the problem with being read your rights that wasn't the problem before?
REP. SCHOCK: Well, first of all, you suggested earlier that reading someone's Miranda rights does not--has never indicated that they talk less to our intelligence folks.
MS. MADDOW: We've never heard that from the FBI.
REP. SCHOCK: The fact of the matter is we do know that after the Christmas Day bomber was read his Miranda rights that he did, in fact, stop cooperating with our intelligence.

Rachel would make a great moderator for Meet the Press. The only time I watch MTP is when I know Maddow will be on the panel. Gregory never asks follow up questions nor chellenges a guest. All soft ball questions.

I would think that the simple fact that the Republicans are the minority party would mean that they are no longer mainstream. They lost that title when they lost the house, senate and presidency.

Abdulmutallab was severely burned, (some say good for him) none the less, he was treated after he talked for those burns, with in the hour, or he would of become incoherrant, from the pain and that means medicated for pain, a medicate for burns person is not a reliable "talker". This is where "thinking" comes in, the Obama administration has taken the course of getting everything we can and keep him talking, for as long as we can approach. The problem with letting Rachel grill these guys, and IMO they deserve all of it, is ratings. If the show becomes about exposing hypocrisy and political lies, the high-profile pols will stay away in droves and ratings plummet. Rachael is respectful of her guests and isn't afraid to allow them to say whatever they want. This is the way a reporter gets information. It's not like she attacks people ala BillO. Maybe if she hosted a show like Meet the Press, it would be a challenge for people to come on her show and know in advance they would be called on their bs. It might just keep them honest.

The truth is I don't know what to think about Mirandaizing somebody like this. I know this is controversial but it is just what I am thinking. I think that the guy in this situation should be tried in a normal court though.
I think that if you have somebody who has just tried to set off a bomb on a plane, I think that it may be a good thing to try to get as much info as possible as soon as possible. Here is where I differ from the Republican/Billy The Bloody/Palin/Cheney Duo point of view; The bomber should never be tortured. Torture gets you nothing but he should be interrogated by professionals who know how to do it. These professional interrogators can sweet talk blood from a rock. Without torturing him try to find out if he knows if there are more bombers sitting on more planes someplace but do not torture him. Maybe I am wrong here. Maybe they should Mirandize the guy but I don't think so.
You know the main problem with Guantanamo is not that it is there or it is used to keep terrorists out of the country, it is that it is a torture chamber. If the Cheney White House never tortured one terrorist then Guantanamo would not be such a big deal would it. The Cheney crew ruined it by using it as a torture chamber and they are probably still torturing people there... or at least beating people to death.

If you waive your rights, that is another story, but if the perp is from another country and their English is not so good or non-existent, then a question will arise about whether or not they knowingly waived their rights. That's the law, and do you really want the authorities deciding on a case by case basis whether or not to advise you of your rights? Innocent until proven guilty. Are we going to let some GOP/Conservative cowards change everything?
I totally understand where you are coming from. What I said is just the way I feel. I don't want anybody to be thrown in jail who is not guilty (innocent until proven guilty). Maybe I should just not worry if somebody else is on another plane with his underwear full of bombs. I have made that point before too. We can't be wimps. But in this case the bomber was caught with his underpants on fire. There is no doubt that he tried to blow up the plane. I don't need a court to tell me he is guilty. I also understand that this could become a slippery slope so maybe we should just lock him up until his court date and see if the court finds him guilty and then sentence him. It is a very difficult situation.

If you get him to waive his rights or have a lawyer in the room. Which works much more often than you would think. First, in these cases his lawyer knows the guy was caught red handed and his best chance is to cooperate. Second the best people in the police and FBI are very good at BS-ing suspects, making them feel like they are their friends. Also, many suspects have a desire to talk.
We have a system that works, its only fear and lies that make us think we need to change it. In the 60's we had home grown terrorists planting bombs and hijacking planes to cuba, no one ever suggested we needed a separate justice system. As Savannah points out, once you let law enforcement decide who doesn't need to get Miranda its over as a right. Suddenly people arrested for civil disobediance or protesting or for resisting arrest because they were unable to get up after they were tazered by a cop (that last one is a real example in the Bay area I heard the other day) won't be getting it either.
Yeah, a cop cannot be trusted with this responsibility. Screw it. Oh, I would never put a cop in the same league as an FBI interrogator. But none of them can be trusted.
everyone is treated fairly. Innocent until proven guilty is nothing if individuals who the perps are exposed to can decide the course of their treatment. That's supposed to be why we call ourselves a nation of laws. I understand your frustration, Captain K. I really do. But logic and honor must prevail. Right? Gregory asked the right question at first, about repub attacks helping al-Qaeda, but failed to follow up and gave up the argument to Schock. After 9/11 congress including dems rallied around Bush, who was at the time a lame-duck for certain. Think it ever crossed the mind of an al-Qaeda leader that if they can pull off another big one, that total chaos and anarchy will be the result. Don't expect repubs to rally around Obama if another 9/11 is pulled off. They won't stop trying to destroy his presidency at any cost, and I wouldn't be surprised at any manuever they might try at that point. They really love their country all right.
