These tough guys sure do have a lot of fear about trusting the United States court system, don't they? During an interview with Andrea Mitchell today Sen. Christopher "Kit" Bond joined the long list of Republicans carping about the Obama administration moving the trial of 9/11 suspects to New York.

Bond: Well I think it’s an insult to the memory of those who were brutally murdered on Sept. 11th to have the leaders behind these cowardly acts of terrorism sit in a courtroom blocks away from ground zero and reap the full benefits and protections of the U.S. Constitution.

I'd love to know how giving these men a fair trial so that the victims of 9/11 can finally have their day in court is insulting them. I would think the opposite is true and that they would be happy to finally have some closure to the whole ordeal. Bond throws this stink bomb out there a bit later in the interview.

Bond: And there is no reason whatsoever to try this person in an open courtroom in the United States with all of the powers that defendants, that American defendants have to get information and expose all of the things that they want to talk about and try to recruit more people like Maj. Hasan who just shown us that Americans can be propagandized and turned into deadly terrorists if they get the word from the leaders who wish to bring death and terror to the United States. I think it’s a disaster.

Yeah, let's wrap this into the tragic shooting at Fort Hood and pretend the two issues have anything to do with each other. Maj. Hasan didn't go on a shooting rampage because he saw terrorist suspects going to trial in the United States. Maybe if we quit dropping bombs on poor people's heads that are not a threat to our country the terrorists out there would have a few less recruiting tools at their disposal.

Bond's real problem with these trials is that they will expose what's been done in our name with this ridiculous "war on terror" that is nothing more than excuse to feed the military industrial complex that Bond and his ilk love so much, and that Dwight Eisenhower so rightfully warned us about.

I'm kind of looking forward to the day that those in the prior administration who said torturing people is ok go to trial.

Part of the reasoning in putting them on trial in New York, is so survivors of the victims of 9-11 can attend the trial.

Actually the Constitution repeatedly refers to the "accused" not citizens per se.

In fact, the average American at first couldn't even perform the most basic right of citizenship, voting, without owning a certain amount of property.

People in territories waiting for statehood, also weren't considered citizens of the United States yet.

The Indians and the black slaves and indentured servants were also not considered citizens, but supposedly had the same legal protections.

Additionally it wasn't even clarified that all were considered citizens of the United States, and not just of their individual states, until the post-war passage of the XIV amendment.

But the Federal protections still applied, at least in Federal courts, and in the State courts due to the VI amendment.

My point is that we cannot possibly be promoting/proud of that very system if we're willing to chuck it all the moment some big bad guy shows up.

This is about America triumphing. Perhaps it's idealistic, but I'd like to think we're capable of sending Khalid Sheik Mohammed off to prison without breaking our own laws.

It's been SEVEN YEARS since 9/11. If the terrorists had the capability to strike in such a manner again, they would have done it on Bush's watch. Especially when we've had extensive memorials at all of the locations, and President Bush was actually on site.

Not to mention, NYC takes their security seriously, putting police officers on the street who are armed with more than a pistol. You are implying that the NYPD, backed by the FBI, CIA, and the rest of the Homeland Security apparatus that a Republican administration foisted on this country ... is WORTHLESS.

These guys confessed and were already convicted by a military tribunal. These guys were enemy combatants not an America committing a petty crime. Where are they going to get a jury of their peers from? Foreign terrorists have no peers in America. Not to mention all the security concerns from the discovery process and under cover agents that will have to testify and there is a chance the judge and jury could let these guys go free, again after a confession and the guilty plea in the military tribunal. When did an entire nation - rich and armed to the teeth - suddenly decide that the world is too terrifying for free people to administer? The Right and the Rapture Readies seem to be the sector that is most psychically debilitated by living in a post-Cheney world. Republicans want military trials because they are kangaroo courts hidden behind curtains. If tried in NYC in a civilian court, there is apt to be the nasty public disclosures about torture, et al.

How do I know about military courts? I served 31 years in the military and sat on several court-martials. In one trial, my fellow board members wanted to discuss the sentence before the trial even started.

I agree with that. The system is rigged from the start. I went through a court-martial in 1985 in the Navy. It was supposed to be a jury of my peers but the officer that handled it wasn't my peer. Not even close. I was an E-1 at the time and he was a Lieutenant. I knew I was finished when I saw his Rank. What I didn't find out until later was that I had already been found guilty BEFORE the trial even started. The trial itself was only for show. He was a nice guy though so it all worked out in the end.

A point was made by another poster about Tim McVeigh being tried here. Is this about not trying terrorists or is this about not trying MUSLIM terrorists here? And, yes, a lot of this outcry is because the Bush Administration and their tactics will be part of the conversation, which will make Republicans look worse.
Honestly, I don't think there is a fear that these suspects will get off. The way I see this, it's a fait accompli. No way do the jurors let these guys walk. Moreover, I think Obama is sending a message, and the message is "If you f*ck with us on our turf, you die on our turf!" Also, it's time to prosecute these bastards and bring some closure here.

A couple of noted items: 1) War was never declared by Congress, thus they can't be war criminals. The crime occured on US soil in Sept. 2001 before we invaded Afghanistan. And 2) the 3 terrorists that bombed the World Trade Center in 1993 were tried and convicted by US court on US soil. Where was the outrage then by the Republicans?

One of the basic historical facts of this country that is lost on the lot of Bushhawks and Cheney apologists is that one of the principles on which this country was founded is that the law, and its application, is to be an open process, accessible to all. Before the US (History majors, please correct me if I'm wrong) laws were meted out by committees of clergy or nobility, and the processes and sanctions were arbitrary, often simply based on the whims of those in authority. Having an open judicial system is a wonderful thing becasue it defines what we are.

I understand that the GOP wants to reconstitute a feudal society, based on the old British model as it was implemented in the South pre Civil War. But the United States as a whole chose a more enlightened path.

Only those who have no faith, are afraid of challenges to it. The Republicans don't believe in America, so they can't stomach any critiques of it.

Yeah, because how can we be sure that an untried document like the Constitution will really work. Lawyer shows show that all of the time.
