This guy Cook should be placed in jail. I'm not sure what the charges would be but the guy is a crook of some kind. He's like a flim-flam man. And his attorney should be barred from every court room in the country.

He won't get shot, but, due to the idiotic advice of his lawyer, he lost his job with a military contractor, because the Dept. of Defense won't allow him onto any DOD installation as a result of his insane lawsuit. To quote John Lennon, "Instant Karma's gonna get you..."

I mean, seriously. This ain't a beauty pageant where John McCain became the runner-up for coming in second.

Vice-President Joseph Biden would take over the duties of Barack Obama upon Obama's death, incapacitation, or inability to fulfill the duties of his office. That would put either President pro tem of the Senate, Robert Byrd; or Speaker of the House Nancy Pelosi into the VP's slot (and SecState Hillary Rodham Clinton would follow Pelosi).

Furthermore, Cook alleges that deployment orders to Afghanistan are illegal ... except we've been engaged in operations in Afghanistan since 2001. If so, that implies that either ALL operations in Afghanistan have been illegal, or that any continuation of said operations is illegal.

The Army deserves a boot to the head for punting - they're simply saying that since Cook, a reservist, volunteered for deployment, his refusing to comply is being viewed as having changed his mind, rather than disobeying a direct order in a time of war.

The army doesn't want the jackass and who can blame them. If I were a soldier fighting over there, I wouldn't want this guy on my team because I wouldn't trust him.

SOMEONE shot Pat Tillman, after all. Incompetence makes a great cover story, but the disdain shown by higher-ups during the investigation suggests there were other reasons.

But an awful lot of officials saw fit to comment on both Tillman's and the Tillman family's atheism.

... 'fragging' wasn't something that was ordered; it was a deliberate act by soldiers to remove a superior officer who was deemed to be clueless or otherwise intolerable.

But, again, there are the officials who went out of their way to express their very Christian outrage and disapproval of Tillman's faith (or absence of).

yeah, thank god no one's running an assassination squad...

... however, I though the burst mode for the M-16 or (whatever it is called these days) is 3 shots. However, that is pure conjecture but the 3 shots for some reason seemed to resonate with that.

In any case, still a complete and utter shame on the Army's part regarding their cover up of the incident. Fallen troops deserve better than that.

Out of curiosity, when speaking of a state of timelessness, doesn't eternity seem to bespeak of a period of time, albeit negative?

Timelessness is a vestigial concept from the Romantic period (early 1800's - forever) and of poetic value only. Space-time, on the other hand, is the conceptual foundation for the General Theory of Relativity (gravity as warped space-time, black holes -- you know the song) and there's nothing romantic about that.

My answer to Major Cook is the same answer I gave to the kids who joined the military, then when Desert Storm came around, acted all surprised that they were going to war and/or that they would have to carry a weapon! Gasp!

I didn't have to go to war, but when the American Embassy was taken hostage, we all just shrugged and made appointments with the JAG office to draw up our wills.

No that's not the reason. The reason is the guy is saying the President is not a US citizen and using that to pick and choose what he will do after volunteering.

I said as much - refusing to deploy either implies:

- Action in Afghanistan has always been illegal.

- Action in Afghanistan was legal until 1/19/2009, then suddenly became illegal, because illegal orders cannot justify the continuance of legal orders. (Say WHAT?)

- Action in Afghanistan has and continues to be legal, in which case the whole 'potential war crimes' spin Cook tried to push is irrelevant.

makes this whole thing absolutely disgusting is that according to the Columbus, GA Ledger-Enquirer, the guy actually had volunteered SPECIFICALLY for deployment. I don't just mean joining the reserves as a volunteer, but contacting the Army and saying he wanted to go to Afghanistan. When did he make this request?

May 18, 2009. As in after Obama was inaugurated.

So, somehow, in May he had no problem with the idea of being deployed under Obama's orders, but now he does.

Worse, a retired 2-Star Army General and active Air Force Lieutenant have joined Cook's suit. The government has already told Cook he won't have to report for duty, and said that his suit was now moot, but

[I]n a pleading revised after the revocation of Cook’s orders, Taitz argues that the application for preliminary injunction is not moot and that retired Maj. Gen. Carol Dean Childers and active U.S. Air Force reservist Lt. Col. David Earl Graeff have joined the suit “because it is a matter of unparalleled public interest and importance and because it is clearly a matter arising from issues of a recurring nature that will escape review unless the Court exercises its discretionary jurisdiction.”

Cook’s resubmitted Application for Preliminary Injunction is meant to encompass the possibility of Cook receiving future orders for deployment as well as to address and prevent “negative collateral consequences such as retaliation against Major Stefan Frederick Cook ...”

As to the retaliation issue, the revised suit states Cook lost his job at Simtech Inc., a corporation that does Department of Defense contracting in the field of information technology/systems integration, because of the suit. It also states that Cook has been subjected to “gossip” from people who believed Cook was “manipulating his deployment orders to create a platform for political purposes.”

Taitz, who has challenged the legitimacy of Obama’s presidency in other courts, filed the original suit with the U.S. District Court for the Middle District of Georgia. Two similar suits have previously been thrown out of federal court.

[Emphasis mine] Gee, he REQUESTS a deployment under President Obama in May and 2 months later files a suit to prevent his voluntary deployment because he doesn't believe Obama is eligible to be President? I can't see why anyone would think he's manipulating his deployment for political purpose...

An article at the Washington Independent says that Cook is a poster at FreeRepublic who uses the name "roaddog727." In March - 2 months before he volunteered for deployment to Afghanistan - he posted a "white paper" by Orly Taitz about the birther issue, and included a note that as a Plaintiff in "the class action suit" he gets mail from Taitz, and that it looked like "things were moving along."

So, clearly, his change of heart between May and July wasn't that he became a believer in the birther theory at some point in there - he was already a believer before he volunteered to deploy.

Mudville Gazette is reporting that the reason the Army revoked his orders even before the suit came to court is that when a reservist volunteers for an assignment, they can cancel that request at any time up until the date of their deployment.

In short, Cook never had to go in the first place. Unlike most soldiers who deploy as part of a unit, Cook - a reservist - had volunteered to go as an individual augmentee. The Army generally seeks volunteers to fill such assignments first - if no one does so then a non-volunteer is tapped.

Taitz, of course, is trying to claim the revocation of his deployment orders as some kind of huge victory. As quoted by the Washington Independent, here's her response:

We won! We won before we even arrived. It means that the military has nothing to show for Obama. It means that the military has directly responded by saying Obama is illegitimate – and they cannot fight it. Therefore, they are revoking the order!

Obviously, it means NO SUCH THING. Since the guy had the right to request the revocation of his orders up until the day he deployed, the fact that they canceled his deployment just means that they got his request. Big victory, that! Also from the Washington Independent, Lt. Comm. William Speaks from CENTCOM responded to Taitz' claim that this validated her beliefs as follows:

“Maj. Cook volunteered for the one year assignment to Afghanistan, in May of this year,” said Speaks. “After he brought this stuff to the fore, the unit that owned his billet canceled his orders.”

Speaks dismissed comments that Cook’s attorney Orly Taitz, made to WorldNetDaily, specifically her claim that “the military has directly responded by saying Obama is illegitimate.”

“This in no way validates any of the outlandish claims made by Maj. Cook or his attorney,” said Speaks. “The idea that this validates those charges about the president’s fitness for office is simply false.”

I haven't paid much attention to Taitz or WND, that is, until this morning when I read up a bit on her. She is one whacked out "attorney." Got her law degree online. Sounds like she needs to be checked into a mental hospital!

And, that WND....jeez, what a bunch of insane, racist haters who post comments there.
