Perry Wants Constitutional Amendment for Prayer in Schools
As president, Texas Gov. Rick Perry (R) says he would fight for a constitutional amendment to allow prayer in schools.
In an ad released last week, Perry declared that President Barack Obama was waging a "war on religion" because gays are allowed to serve openly in the military and children aren't allowed to pray in schools.
"It was the Supreme Court, back in 1962, that decided -- and it's been upheld since then -- that children couldn't pray in school," Fox News host Chris Wallace told Perry Sunday. "Barack Obama had nothing to do with that."
"I would support a constitutional amendment that allows children to pray in school anytime that they would like," Perry declared. "I happen to believe that ought be a local decision, and that's not the Supreme Court's business to be telling Americans when and how they should pray."
"On the issue of Don't Ask, Don't Tell: It was working, and for the Commander-in-Chief to use our military as a political tool while we're in combat in two different locations around the world -- at least two different locations around the world in Iraq and Afghanistan -- I just think it's really irresponsible. ... I think [the lifting of DADT] is bad public policy and I would change it."
Wallace noted that the ban on prayer in schools had continued under both Republican and Democratic Presidents.
"I'm telling you what I believe, Chris," Perry replied. "Americans don't agree with that decision that was made in 1962, and if we have a constitutional amendment election across this country allowing our children to pray in school, I will suggest to you it will pass overwhelmingly. And I'll support that. I will go across this country, as I am promoting a balanced budget amendment to the United States Constitution, I will work on a balanced -- or I should say an amendment to allow our children to pray in school."

The fact is: any kid can pray in public schools at pretty much any time they want. It's the school officials (teachers, principals, coaches...) that are barred from forcing kids to pray.

Would someone tell these asshats that you can pray in school but the school can not organize prayer. Before 1962 some schools used to have a prayer that was put over a PA system and that's is what some objected to and why "official sanctioned prayer" is no longer allowed.

I was going to send him an email, telling him that I support a constitutional amendment that would prohibit religious right nuts like himself to never run for public office. But, alas, it appears as if Parry's website no longer has the ability to "Contact" him, unless it is for a donation.
I know the website used to have this ability. I've sent him a number of emails the past few months, including a most recent one a few days ago, after his latest commercial comparing gays being open in the military with children not being allowed to pray in the classroom.

I think a generic 12 Step program should be part of the school curriculum, even if it's just the Serenity Prayer. Our addictions and moral shortcomings are rooted in our genes and upbringing. Learning at an early age; how to accept the things we cannot change, the willpower to change the things we can, and the wisdom to know the difference would make the transition to adulthood a lot easier.

Let's remember that this is the same man who hinted not long ago that Texas might want to secede from the union, who publicly stated his opinion in his most recent book that the Seventeenth Amendment was "mistaken", who doesn't know that teenagers are eligible to vote once they turn 18, and who apparently disagrees with the Constitution when it comes to the President's prerogative to appoint Supreme Court justices and have them vetted by Congress (what most people seem to have missed is that he called the Justices "unelected and unaccountable" as well as getting the number wrong). Since the Presidential Oath of Office would require Perry to "preserve, protect, and defend the Constitution" in its current form and not in the form he might want it to take, can Perry be trusted to uphold the oath given the numerous statements he has made -- provided, of course, that the American people collectively lost their heads so completely that they elect him to the office? No...he cannot. Unless Perry is fully prepared to honor the Oath by adhering to the Constitution as it currently stands, he should not only not be running for President...he should be considered ineligible to run. If Perry wants to "preserve, protect, and defend" his own interpretation of the Constitution, then he should either put a proposal for a new amendment before Congress in accordance with the correct procedure or he should get his own damn country.

As you know, We've been working real hard in our town to get prayer back in our schools. Finally, the school board approved a plan of teacher-led prayer with the children participating at their own option. Children not wishing to participate were to be allowed to stand out in the hallway during prayer time. We hoped someone would sue us so we could go all the way to the Supreme Court and get the old devil-inspired ruling reversed.
Naturally, we were all excited by the school board action. As you know, our own little Billy (not so little, any more though) is now in the second grade. Of course, Margaret and I explained to him no matter what the other kids did, he was going to stay in the classroom and participate.
After the first day of school, I asked him "How did the prayer time go?"
"Fine."
"Did many kids go out into the hallway?"
"Two".
"Excellent. How did you like your teacher's prayer?"
"It was different, Dad. Real different from the way you pray."
"Oh? Like how?"
"She said, 'Hail Mary Mother of God, pray for us sinners...'"
The next day I talked with the principal. I politely explained I wasn't prejudiced against Catholics but I would appreciate Billy bein transferred to a non-Catholic teacher. The principal said it would be done right away.
At supper that evening I asked Billy to say the blessings. He slipped out of his chair, sat cross- legged, closed his eyes, raised his hand palms up in the air and began to hum.
You'd better believe I was at the principal's office at eight o'clock the next morning. "Look," I said. 'I don't really know much about these Transcendental Meditationists, but I would feel a lot more comfortable If you could move Billy to a room where the teacher practices an older, more established religion."

"Nephi what?"
"Nephi," he said. "It's in the Book of Mormon.
The school board doesn't meet for a month. I've given Billy very definite instructions that at prayer time each day he's to go out into the hallway. I plan to be at that board meeting. If they don't do something about this situation, I'll sue. I'll take it all the way to the Supreme Court if I have to. I don't need schools or anybody else teaching my son about religion. We can take care of that ourselves at home and at church, thank you very much.

I've been practicing educational law on and off since the 1980s. This is my practice now. It is perfectly legal for little Johnny or little Jane to throw up a prayer, even out loud, during the school day, so long as it does not disrupt the educational setting. It is perfectly legal for religious societies to proselytize little Johnny and little Jane at after-school meetings in school facilities. In the Eighth Circuit, it is even legal for little Johnny or little Jane's teacher (and probably board members and administrators) to join in the proselytizing. The only thing that is not legal is for the school board to prescribe religious instruction during the school day, or for school personnel to preach during the school day. Think about that, Mr. Perry, the next time you see a majority Muslim Board.

Well, Mudshark, since I'm new to this system and can't seem to figure out how to "Reply," I'll just do it this way. I rather doubt that a school system getting direct public funds could allow periods for Islamic ritual during school hours. That would require, at minimum, that any religious ritual prescribed by any religious group be accomodated, which would result in a religious cluster f__k that would disrupt the orderly educational environment. But, it could be done with a taxpayer funded voucher system allowing parents to pay private schools with a state-issued voucher, I think, playing off Zelmon v. Simmons-Harris. The after-school proselytizing is permitted by the Good News Clubs and Lamb's Chapel cases, in which religious groups are permitted to use school facilities to "evangelize" young children (if memory serves, 6-9 years old) if the school has established a limited public forum (i.e. if they let other groups use school facilities outside of school hours). Good News Clubs are the "face" of the Child Evangelism Fellowship, and sort of advertise themselves to parents as an after school day care service without directly mentioning the religion component. In other words, in my opinion, a bunch of sleazy jerks. I get asked about these people by a school system at least once a month. My advice is just don't let any private group use the schools for any purpose. The next question goes something like, "But what about the Boy Scouts?" Aside from the fact that the latter is also a religious group, the practical problem of keeping the fundamentalists from the door of unsuspecting parents and their children is enormous. I have another suggestion, but no one wants to spend the money on the inevitable litigation.

What if you have multi-demoninational classroom, including atheists, agnostics, or what if the teacher, or whoever is leading the prayer, is hyper religious,one of those who goes around amen'ing, and praising the lord, reciting scripture, or giving religious lessons in class. My School System still has Prayers before Ball Games and other Ceremonies! BUT School Officials can not influence who says the prayer or the prayer's content.
Students still meet before School in a class room for Bible Study and prayer; NO TEACHER or School Official can be present.

He still whines about prayer in school but has not yet come up with a single word to put into the prayer he seems to want. And he is a Phi Beta Kappa Ph.D, in Linguistics, and he can't come up with a universally acceptable prayer.
Wonder why?
(Hint, it because he won't accept anybody else's, and he knows that there are many others who would not accept his.)
