Fox News' Chris Wallace hailed conservative filmmaker James O'Keefe as the "Power Player of the Week" Sunday. When asked about allegations that he broke Maryland wiretap laws by recording ACORN employees with out their knowledge, O'Keefe confessed that he didn't know.

Unless he taped a telephone conversation, he's not guilty of violating wiretap law. He is, however, probably guilty of violating other laws regarding covert recording.

I thought wiretap laws were also used to govern the 1 or 2 party agreements when it came to any sort of audio recording, telephone or otherwise.

I never watch these clips, they are entirely predictable scripts of the Corporate Mouthpiece Media.

My concern was with the choice of words of the post.

You say:

I cannot argue this without listening to it, which I won't do. On the face of, to my thinking, there is a better word than 'admit'.

To admit would be to confess, the previous word used. He is being sued, I understand, he must have counsel. He may be prosecuted according to Jonathan Turley (my previous comment here). If the counsel is worth two grains of salt then this person is coached on what he can and cannot say.

HE SAYS he doesn't know. That is the phrase I would use. He knows what he did, he knows what his counselor tells him.

If his counselor is even a little better than than two grains of salt, the counsel would be DON"T SAY ANYTHING.

I have no sympathy for him, let him go out and hang himself. Legally speaking that is.

Then O'Keefe goes into equating illegal taping with child prostitution. He never says anything about his own culpability.

Why is Wallace saying that O'Keefe is a "progressive radical"? Anyone who holds 'bake-sales' allowing whites to buy goods cheaper than other races is NOT a progressive.

Actually we don't know if the ACORN workers were trying to help someone scam the government,

That certainly appears to be the few's actus reus, but it requires knowing their mens rea as well as concurrence.

And that's for a court to decide, if the the prosecutor thinks they have a case.

But the fact that it was not part of any official investigation, and would require using evidence most likely illegally gathered to initiate the case, means that any such trial would be unlikely, unless there's more evidence forthcoming that was Constitutionally gathered.

According to a Congressional report, the group has received $53 million in federal funds since 1994. But the nonpartisan Politifact.com reported in May that most of that money went to the ACORN Housing Corporation, one of the group's many affiliates.

ACORN is an easy target for the Corporate Media who are the Corporate mouthpiece.

$53 million in 15 years is less than $4 million a year. This amount is a speck of dust compared to the billions stolen by the crooked war profiteers.

In Michigan it is legal to record conversations that one is party to. In other words, one party consent.

As long as one person knows no matter where they occur, except over the telephone.

Telephone conversations require two party consent.

Actually, he himself brought up the subject of child prostitution in that set-up with ACORN, and should be just as liable for prosecution.

It also does nothing to change the fact that his apparent purpose wasn't to prevent child prostitution, but to close down a group helpful in signing up new voters, and suppressing that vote.

I seem to recall one statement from someone with ACORN to the effect that at least one of the ACORN employees 'caught' on tape knew that there was something not right about the whole thing, and that the employee was just going along with them trying to find out what was going on, not seriously giving advice on illegal activity.

After all, aren't they the ones who are always pontificating about the importance of "accepting personal responsibility" (even though most of them make every effort to pass the buck just like everyone else when their own backsides are on the line)?

I still have to wonder why some of the staff members at ACORN caught on camera apparently weren't swift enough to suspect that something funny was going on, given the fact that the female accomplice's costume in some of the footage was almost too obvious to be believable -- it was as if she was acting out a stereotype (or perhaps a caricature) of a prostitute when one would think that a prostitute trying to get advice on how to keep her true business a secret and make it seem legitimate would be more inclined to dress down for a meeting such as this.


Never trust anyone who insists that patriotism requires you to blindfold yourself with the flag.
